Default Bruin 350 Brake Problem

I have a new 350 Bruin 2w drive and the rear brakes are crap. The rear brakes will not hold the machine from rolling backwards without help from the frount brakes and if I have racks loaded with about 70% Max. the frount will slide dn the hill while the back rolls and it won't sto till it get to the bottom. The dealer tried 2 different sets of pads and a new drum. The factory rep looked at it and said they're working the way they are supose to and if I wanted to carry this any further I needed to get a Lawyer. I am afraid to take my wife or children out on it and something happen and it crash with them. Anyone else have a bruin should check this before they get in a comprising position. If you have a Bruin try this and let me know. And if you know how I can get others to put pressure on Yamaha Please let me Know.
