Agency Action Notice, AAN-U-00-82

In cooperation with the U.S. Consumer Product Safety Commission (CPSC), Polaris Industries Inc., of Minneapolis, Minn., is voluntarily recalling about 13,600 All-Terrain Vehicles (ATVs). The throttles on these ATVs can stick, preventing the ATV from slowing down when released. This can cause the vehicle to lose control and crash, resulting in severe injury or death.

Polaris has received 26 reports of problems with the throttles on these ATVs. There have been 17 reports of crashes resulting in six consumers suffering injuries.

The recall includes some model year 1999 Scrambler, Sport, and Xplorer 400 ATVs, and some model year 2000 Scrambler and Xplorer 400 ATVs. "Polaris" and the model name are written on both sides of the ATVs. Polaris dealers will help consumers determine if their ATV is part of this recall.

Polaris ATV dealers nationwide sold these ATVs from December 1998 through July 2000 for between $4,800 and $5,900.

Consumers should stop using these ATVs immediately...

I posted that a while back and no one seemed very interested. I mainly got replies like, "my throttle has never gotten stuck." Hope people will heed your pertinent warning and have their bikes checked. If not for their own safety, then for anyone who might be allowed to ride their ATV.

Yes this is old news, but still news to know. You see I am one of the ones that crashed! I am now riding my new HO because my 2000 Scrmbler has been in storage since the second accident. I cannot say anything more about this at this time for obvious reasons.

Two accidents, unfortunately yes. The first was the first time I actually hit the throttle to near full to help slide around a turn. The Scrambler had about seven hours on it at the time and was still being broken in. I backed off the throttle after the turn but “We” did not stop until the Scrambler was upside down on top of me, still running at near full speed further down the path. I broke both my ankle and leg. The machine was taken to the dealer and checked but they found nothing wrong. That happened in April. In late June with another family member on it, the Scrambler became stuck in a rut. The back tires had dropped into a large rut in the mud made by a truck. My in-law said no problem, engaged the four-wheel drive, and began to rock both the throttle and the Scrambler. Well in about half a second up and out of the hole it came only problem was it would not stop. He yelled get out of the way and jumped off as the now un-manned Scrambler drove past my self and the whole group we were riding with! Again, it came to rest upside down and still running at or near full speed. I thanked God know one was killed that time. Now it was obvious something was wrong. No one has been on the machine since except the mechanic at the dealer ship. It was shortly after that I found out about the recall. As soon as I told Polaris what happened they wanted all the parts off my machine sent to them (from the thumb control to the carburetor). Only one problem, they also told me my serial number did not fall into the units being recalled. The dealer did however inform them my throttle “DID” match the service bulletin for the recalled units. It was then I also contacted the Consumer Product Safety Commission. I felt I should talk to them about this because it was they that posted the recall in the first place. They requested the parts be shipped to them first, and they were. Well I can tell you this as of right now that Scrambler is in storage with less then 10 hours on its clock, still in pieces. I am riding a new HO and loving it. Polaris and the CPSC are still investigating the incident. And life goes on.

Also incase you were wondering, I sold my Ritter-ized 97 Scrambler to buy the 2000. I don’t claim to be an expert rider by any mean but what happened those days could not of been prevented by the driver. There is more to this story but it can’t be told at this time.

Not to down-play your bad incidents StockSP500, but I went to the dealer about the recall. It was just the throttle cover that needed to be changed. The new one is identical but has a dinky rubber seal inside/around it, thus preventing humidity from getting inside and freezing in very cold weather...or rust.

The dealer handed it to me and I popped it on. The legal mumbo-jumbo just made the recall sound worse.

Yes I know all about the cover but another problem has surfaced. As reportrd by XXXXXXXX XXXX Polaris (Olean, NY) to the CPSC he had found some of the throttle cables had been routed wrong on some of the machines. This included one he had that would not stop! This is not the dealer I bought mine from. This information was confirmed to me by the owner.

Ooops! Now that sounds a little more serious than just the cover!

I hope mine doesn't stick this week-end!
(I will keep my finger near the kill switch just in case...)

Does anybody use a tether switch on their Polaris. I wasn't planning on installing one, but after the above stories I wonder if I should get one.
