Default I want proof

I've have seen people on here writing about how the government passed a law not allowing atvs to go over 80mph.I have a hard time believing this.Does anyone have any proof about this law.Maybe a magazine article, newspaper article or a copy of this law.

Two possibilities: Google the terms "atv consent decree", and see what you come up with. It may be that in the agreement with the CPSC, that they agreed to keep the speeds down. I also heard that the manufacturers agreed between themselves, but I don't know how one would check that one out.

I would have to agree with ReconRanger as consent decrees with CPSC is often the common practice and was done this way with the 3 wheelers. While there are laws governing how fast a motorized vehicle operates on public highways, there are no controlling statutes as they relate to operation on private property. If this were the case, you could not have NASCAR, NHRA, AHRA and so on. Certain UTV's were signatories to an industry agreement to keep the speed down, but the more recently introduced RUV's were not a part of that, thus the faster speeds.

Some people say they've been clocked at over 80 mph. One guy said he even had a ticket to prove it. As far as I'm concerned, until someone can prove the 80 mph limit it's just hearsay.

I remember hearing this many years ago.......

But the fact is, that there are no machines that will do 80 right now out of the factory. I don't think the gearing is there on anything........ certainly with a sprocket change 80mph is not a problem at all...... most Baja machines will hit 85-90 with just a gearing change......

Oh I agree there is no stock atv that will run 80mph but I dont think that it's because of some law.But I may be wrong about the law thing.Thats why I would like to see some proof. Its just that alot of threads about "top end speeds" will usually have someone saying that they heard there was a law about it and I just wonder if there was ever a law or like reconranger said maybe some kind of agreement.

It was more of an agreement to keep the ATVs from being banned like the 3 wheelers. If there was no regulations why would ALL of the 450s have a top speed of about 73-75mph. They are more than capable of exceeding that speed. If there was no agreement/regulations, can you imagine the law suits on companies? There would be machines pushing into the 90s and there would be twice as many deaths from ATV crashes.

Where did you read about this agreement?
