Default Getting sued.

Hi quick question. Im getting sued for selling an atv that apparently was seriously broken. Am i in trouble?

If you weren't aware of any problems or didn't deliberately try to cover up any damage,kinda hard for a buyer or even a judge to hold you responsible especially on a private sale if it was sold as is. Any one can sue someone for just about anything but making a case out of it is another thing. Only ones that win on cases like this are blood sucking lawyers.

Like OPT said, the burden of proof will be on the person suing you. Do you have any paperwork that offered any kind of guarantee? More importantly, do they?

Was it broken before or after you sold it? If the buyer broke it that's not on you.

No warranty. Something broke in the drivetrain. Not sure. Worked fine when i had it

Then don't worry about it. You sold it in good faith with no warranty implied..

I did sell it with good faith. But the buyer is being very demanding and knows people in the court..

The Bill of Sale should have said "being sold as is" and "without warranty" and should have been signed by both parties...It's also a good idea to have a witness present and have their signature on the document as well...
