Question about lemon law or other course of action?

Default Question about lemon law or other course of action?

My brother bought a new Honda 400ex (quad) on New Years Eve and we went riding on Sat. The counter sprocket and shaft started coming out the side of the motor 2hrs. into our ride. It chewed up the case around the sprocket and metal shavings got in the motor, I believe they will have to replace the case to fix the problem. If so that means they will have to remove every thing from the old case and install it in the new case. Is there any laws that would apply to quads so he could get a new quad? If I bought a new truck and the motor blew up on the way home I would want a new truck not a repaired motor.

Generally speaking, lemon lays apply when a problem persists and after a certain number of repair attempts the problem is not fixed. Sorry, this isn't a lemon law situation.

I hear you, together we have had the following quads:
2001 Warrior, 2001 Blaster (stock), 2001 Blaster modded, 2002 Grizzly, 2000 Bear tracker, 1999 300ex, and now the 400ex. He was looking at the Raptor but didn't want to spend that kind of money and saw the 400ex with DG bumper, full skids, nerfs, and a Yosh pipe for $6100 out the door and took it.

My brother just got a call from Honda and they said "we had a tech from Honda come out and look at it, they came to the conclusion that the chain was to tight from the factory and the torque pulled the counter sprocket and shaft out of the motor. Looks like it will be down 2 weeks from what they said and they will be rebuilding the motor that it came with. I think this is crap, I would not want a motor that has already been overhauled with 2 hrs. of use. Do you think the quad will be the same?

I believe all the dealer is obligated to do is fix the problem. No replacement machine. They may give him an extended warranty on the engine if he pushes for it.

Be glad that Honda is going to make it right at least. These things happen sometimes and all you can ask for is that is repaired. Think of all the 2001 Raptor guys with blown trannies that got nothing from Yamaha.

You should never even know the work was done after it's finished. It will be as good as (better in this case) than new when it's all done. Look onthe bright side - t's getting fixed and it didn't happen when you were away on a long trip or something.

Yes, it could end up put back together than it was original.

My Short story: New 96 Honda Car with about 100 miles on it. Later that evening, oil was flowing like blood under the car. Tech says: Blew rear main seal. They give me rental car while being fixed. Received car back couldn't tell they did anything. Ran great up until someone decided to come out of nowhere and she was totaled with over 70,000 miles and used no oil.

Oh and one more thing I would not blame this on the dealer and be as nice and happy go lucky as you can be. Bite lip if necessary not to say something you might regret later.

He did buy the 4yr extended warranty at the time of purchase, it was part of the $6200 out the door. Maybe I'm just to damn picky! lol... It probably will be as good as a new one when they are finished, it's just the thought of them pulling all the tranny parts out and putting them in the new case that makes me scaried. They said the chain was put on at the factory, I thought the dealer assembled the quad, if it's coming from the factory with the chain in place what the hell are we paying assembly fee's for? lol....

Bought a new truck back in 1979. Had it in to the dealer 6 times with a trans problem, never fixed. 5,000 miles out of warranty, (back then 120 mo or 12,000 miles, the truck was mo old and 17,000) finally got a factory rep to admit the trans had a problem. The mechanic that was doing the repairs condemed everything inside. A new trans cost the dealer $450, Ford said to fix what came in it. Invoice was for $1300. FoMoCo paid 1/2, the dealer who never fixed it while it was under warranty paid the other 1/2.

It would have been cheeper for them to replace it, but I guess rules are rules. I ended up rebuilding that trans when the truck reached 196,000 miles.

I know how you feel but give them a chance to make it right. I am sure things will work out OK.
