The person at fault is 20 years old and has a high risk insurance policy with almost non-existant customer service. The insurance company hasn't even done anything with this claim yet. They don't return phone calls and you never can get a hold of anyone.

Scooby,

If in a couple of months (or whatever length of time) you are at your wits end with the company, I'd bet everyone in here has a cell phone, and 90% of them probably have free long distance (some probably don't even know it) and I'm sure we could all make some calls to that company (we'ed have to find a number they answer first!) & see if we could goad them into something. With enough bad press perhaps we could get something done, however it's best to go the 'normal' route first.

Every state has an insurance regulator. Has anybody tried to contact them?

$15,000 is the minimum required property damage coverage in Texas. That's what the driver at fault had. There was my Jeep with minor damage, another car with minor damage, my trailer and ATV that all has to be under $15,000 for repairs.

YOU CAN FILE YOUR LOSSES with your own ins co and they will repair everything and go after the other ins so you dont have to that way everything is covered(i have done this before) that is the best way to get everything fixed right if the other persons ins is maxed out they will go after the person and there belongings so you dont have to spend your time and money trying to chase everything yourself.

I tried that already. My insurance company initially said I could do what you said, but after talking to the adjuster, he said I didn't have comprehensive coverage on the trailer or ATV (liability only; trailer and ATV itself not covered but damage they cause to other people is) so the insurance company of the person at fault would have to take care of trailer and ATV. That sucks, sure your neck does not hurt a little???????????????????????????????????????????? ?????????????????????????? No reason for you to get screwed when it is not your fault.

Scooby I would suggest that if her insurance company dosent take care of it .... then I would suggest going for a suit. File a lien against her or her property. File against the property first this way you may be able to forclose on it and take possesion. If you file against her it wont go away till you get paid and it will cause problems with her all over the place. Speak to a Lawyer on this matter.
