My Renegade occassionally has the same problem. I notice when it wont start in gear with the brake on, the brake light doesnt work either. Other times it works, go figure. I figure there is something not adjusted, or the mechanism to over ride it is faulty. Let me know what you find out. Does it ever work, or is it an on and off problem. For some reason, i think mine does it more so if it's really cold, maybe something is freezing that gets actuated when the brake is depressed. In any event let me know what you find out.

The start in gear feature is connected to the brake light circuit. If your brake light is not on and is not burnt out, the bike will not engage the starter. Look there first. Sometimes the brake light pressure switch is faulty and requires excessive pressure to make the brake light function even though there is plenty of braking force to stop the bike. Try squeezing the brake until the light is on, then try engaging the starter. Obviously, if the starter will still not engage then the problem is elsewhere.

Mine works some of the time and other times it doesn't but the brake light doesnt work either when it wont start so there has to be something wrong with what activates the brake light, because it also allows the motor to turn over in gear. Its not consistent though on my Renegade.

Ha Ha, shows how much I know, my 800 has NEVER started in gear, only in park or neutral. I thought it was like that from the factory!

Hey by the way, for anyone still interested in this thread, I havent had a problem with mine since it's gotten a little warmer. I asked a tech at the dealership and he suggested the extreme cold temps may have caused the fluid in the master cylinder to thickening up and thus preventing it from actuating the override feature. Does anyone know if that can be adjusted so the brake light will come on sooner and with less brake pressure applied?
