I recently sold an ATV to someone. Now they want to take me to court or for me to buy the ATV back. Do they have any chances against me?

Sueing for what? Cant just sue to get your way, there needs to be a real reason.

he says i knew the atv was damaged and didnt disclose it to him..i gave him time to look over, sold without warranty.

Sold as is and he gave the bike a good lookover then his tough luck ...It pays to shop wisely! He would have to prove you had knowledge of a defect and intentionally covered it up...and that is extremely hard to do !!!

yes he def. looked at it, just dont want to deal with court and dont want to buy back something after 5 weeks of ownership that the guy had. idk what he could have done to it after this time..

If he wants to waste his time suing you, let him. He's not getting anything, just like when my neighbor when he took me to small claims court. I was in and out in 5 minutes. The judge told him he didn't show any proof I did anything wrong or how much it would cost to fix it. Unless he gets a couple of written estimates from dealers or repair shops, and proves you knew something was wrong like Kymco 450i said, the judge will tell him GTFO. That's if you even go to court.

Desperate people make mistakes. He would probably make a fool of himself in court like my neighbor did. He got the judge mad when he used the word "shit" in court. What a moron.

Looked it over before he bought it. No warranty. Had it for 5 weeks. I'd say he needs to show proof it was like that when he bought it. Like pictures of it when it was still on your property and where the damage is.

Like the others have said, he's got no case.

Depending on his relationship to the judge.

There's no telling what he did with it in 5 weeks. It would be different if he brought it back the next day, but no warranty means no warranty.
