Dear ATVC: I purchased 2 ATVs about 4 months ago. When I purchased them from the original owner, he gave me both a bill of sale and the original titles to each. We are now contemplating selling 1 of the quads as we’ve since purchased a larger one.

My question is, I have not titled either of the ATVs in my name since we purchased them. If I sell the bike to someone new, are they able to use the original owner’s title or would it be best for me to title the machine prior to selling?

Off-highway vehicle registration requirements vary from state to state but as a general rule there is no time limit on the ability to register an ATV after the time of purchase if you posses the original title. Likewise the machine does not have to be registered by its prior owner for a current user to register (again so long as they posses a clean title, can provide a lien release if there is a lien on said title and in most states, a bill of sale to prove that the machine wasn’t stolen).

In short: You don’t have to register it to yourself in order to sell it. We often encounter ATVs that have never been registered in an entire lifetime of transactions that we register with no issue by simply producing the original title and bill of sale.
