Dealer lied about recall... What to do?

Default Dealer lied about recall... What to do?

A little bit of background.... I picked up an 04 from a small local Bomb dealership on 4/2/05. I paid $5300 because it was a leftover 04 they recieved from a dealership in PA that went bankrupt. Anyway before I picked it up I asked if it was on the recall list, the owner was very quick to say it was fine. So fast forward 3 weeks, the weather gets nice and I am getting ready to take it out for the first real ride, so I take it for a spin in the back yard and the oil light comes on. I get towed back to the garage and take it into the dealership fist thing in the morning, let me just say the dealership is over an hour away and I have to go through rush hour each time I take it or pick it up. They have it for a week so I give them a call since I am going to Silver Lake that weekend. Anyway they get it back to me on Thursday night and we are leaving Friday, it was just the sensor.

I get to Silver Lake and notice when I rock back and forth my bike is making a popping or clicking sound, so I pack up and drive the six hours back home. Call the dealership and take it back in, an hour away through traffic. They have it two weeks this time, so I call today and they say it is ready to pick up. Get there and see my bike sitting outside, so before I go in I hop on it, rock it back and forth and it still pops, WTF. Go in, talk to the owner and he says the axle bearing were toast, I asked if it was because of the recall and he says NOPE, not on the list, but fixed under warranty. So I ask to speak with the mechanic (super nice guy), show him it is still popping and he says hes puzzled, said maybe since the bearings were back it caused the bushings where the swingarm connects to the frame to go bad.

He asks if I want to take it anyway, I said hell NO, I need it fixed RIGHT because I am going to Silver Lake again on the 18th. So another hour back home and I am pissed. I look up the recall list on the Bomb website and my effin serial number is on the list.

HOW SHOULD I HANDLE THIS? I mean if he would have done the correct recall before I picked it up I wouldn't be out 3 weeks of riding, a wasted trip to Silver Lake, another one on hold, and 6 wasted trips up there.[img]i/expressions/face-icon-small-mad.gif[/img]

I'd take the list to him and ask for some compinsation for his laziness. ( not checking in the first place)

Cut his nuts off. Seriously tho, how dumb do some of these dealers think people are? You spent over 5k for a ds, you should get some respect from this *** clown. Didn't he think you would look into this. Tell him you want him to honor the recall. I don't know what you can do if he doesn't tho. I bet you aren't the first person he's screwed over.

Tell him to do the recall and if he refuses call Bombardier customer service and talk to a c.s. supervisor , be nice to the c.s. people - it will get you much further . I've heard of them extending warranties to people that were screwed over bad by thier dealerships , but thats pretty rare . The c.s. people can put alot of preassure on the dealer to make sure you are completely happy . its cheaper than you driving back and forth .

My 04 was not on the list for recall but it had the same bearing problem. I fixed it myself to be sure it was done correctly.

Why not CALL down there and tell the guy that your quad is in fact on the recall list. Offer to fax him proof and / or give him the web address as well. Given the situation, I would then tell the guy I am gonna have to contact Bombardier if this is problem is not taken care of promptly.

That really stinks when there is no other dealer around. Sounds like its all a waste of time. Hopefully word of mouth will hurt this guy. You can do this yourself and that sounds like the only way it will get done correctly. I just did my own and Im sure any questions you have the forum guys can help. Good luck with everything and the more you learn to do yourself the better off you will be.

Well, apparently they did the recall on the bike already, he showed me the toasted bearings. But there are still two issues.

1) Why did he lie to me about it being on the recall list in the first place, I mean I asked him about it before I picked up the quad when I bought it. Is it something he could have overlooked, or did he not even check in the first place?

2) When I went to pick it up last night after the recall was completed, it was still making a popping noise when you rocked the quad side to side. The mechanic thinks the back bearing going out ruined the swingarm bushings. So now his laziness has caused a whole chain of events and more bad parts.

Hypthetically speaking, say he was lazy and didn't check the recall before he sold it and lied to me or did check it and didn't want to fix it. So I go blasting down a fire road at 80mph thinking I have a perfect bike with good bearings, the bearing sieze causing me to wreck, getting injured very badly like the recall letter says. Is the dealer responsible?

<edit>Sad thing is they appear to be family owned, very nice people and so far I have given them the benefit of the doubt. I have been VERY accomadating, cordial, and understanding. We'll see what he says this morning, when he is suppose to call.</edit>

Hey buddy, I don't understand this guys angle. I'm the Warranty Manager at a dealership for a large equipment manufacture.I'm responsible for all recalls and product improvement programs. He has nothing to benifit by being dishonest........unless he is submitting warranty claims for this recall and not actually performing the repair.He may have already submitted a claim on your bike and received payment and now doesn't want to do it ????? I'm not sure. I'd go straight to the manufacturer and tell them the whole storey. I have seen in some cases where the recall list provided to our dealership by the manufacture is incomplete or wrong.Most manufactures I deal with reimburse very well for recalls or programs....they pay much better then warranty repairs for breakdowns and failures
