are you sure it's not the etc that is not the issue? make sure you have about 1/8" slack in the throttle cable at the throttle so it won't kick in the ect override. just a thought.

Its not the adjustment, its the assembly its self. So if I just cut the two wires that go to the contacts and put wire nuts on them, it should bypass the switch because it will keep them from touching? Correct?

Yes, take the two wire from the kill switch splice them together and its like the kill switch is off permanently. Just use the key to turn the ATV off.
Looks like there are more then two wire on that switch but 4
kill swich off is black wire to brown wire.
kill swith on is red/white wire to orange/black.
So I think you want to make sure black does not touch brown and then splice red/white and orange/black together.
