Florida Title Law - Bank Repo

I am interested in an ATV and need to find out about the way Florida handles Titles for ATVs. The owner says it doesn't have a title. It is a 2005 Honda 450R. Here is the email I got about the ATV that I am interested in:
"the thing about the title is I bought the bike from america honda finance, it was a repo bike, it looked and rode brand new, they just dont retitle a bike after that, i have all paper documenting it that is notorized. Up until a year or so they never had titles anyway."
Is this the truth or should I stay far, far away from this deal?

All ATV's can be titled, just not all states require it.
However, I can't imagine a bike that did have a title that was run through Am Honda finance not getting retitled. I'd check into it a little more - maybe contact Am Honda with the VIN number and see if they dod have it on record.
I painfully remember the only time I purchased a bike that turned out to be stolen - the guy I bought it from had an answer for any possible question about the bikes heritage.

here's the deal: Ive NEVER seen a bank, finance co. give up a title BEFORE something is paid IN FULL(contract fulfilled); the point is - If American Honda repossessed it - it WASNT paid for so AMERICAN HONDA FINANCE still has the title since the contract was violated and prompted a repossession. They will not hand over a title then reposses it - it doesnt work like that. They want their money IN FULL before a title is handed over. ANY financial institution works like that. And, no, they would not re-title it in a case like this- there is no need to when it is on file.
If the guy bought it from american honda finance (?), then the same process, same title is still in effect and american honda still has the title IF he financed it through them. Otherwise, it's financed somewhere else and THAT institution has the title, acquired from AM Honda...until that finance contract is PAID IN FULL...
Just remember this-
For consumers regarding loans:
PAID IN FULL = TITLE
NOT PAID IN FULL = NO TITLE
One more thing: I know in our state, the title is actually prepared by the dealer and necessary forms sent to the financial institution, DMV, insurance place, usually on the same day or few days after a purchase is made. If american honda never had a title- i would suspect the dealer didnt properly send in the paperwork.
This happened to my cousin on his raptor. he paid it off- but never got a title and after
investigation, he found out that the dealer did not send it to yamaha finance corp. when he bought it. Once they did, he got his title. he was pissed off, i would be too. when i buy something, i want the title saying it's MINE!
This could be the only redeeming factor in your situation with this deal...do some investigating with AM Honda like the other dude said and if they indeed dont have a title then find that dealer. or just find another bike. there are many 450s for sale around here- in great condition. i could tell you some places to go to get nearly mint condition ones that people get, and run a tank or two of gas through them and trade them in on something else b/c they could not handle them...and they are LEGAL machines, not stolen!!!

Now that you mention it, that makes sense. I am new to ATVs, so I didn't know what the title laws were. I couldn't figure out why they "couldn't" re-title an ATV. Now if there is still a lien on the title, that would be a good reason why he doesn't have the title.
