If you are going to call the police. Get out there and take some pictures of the quad and the damage. Try to get a plate number on a quad or truck.

Just help the guy get his quad out and make sure the sherrif is there to arrest him for tresspassing when you done. Dont forget to sue for damage to your property . Problem solved. And legal too.

Given no major harm done, I would give the guy a break. Any tractor or a truck with a winch should be able to pull that out of the mud. Is the damage to the creek any worse than a 10 year storm? If you have never asked the guy not to ride your land then I wouldn't make a big deal out of it. Yes, I am a property owner too who has people riding on my land. People often post for insurance purposes and then turn a blind eye to "trespassers".

Something to think about...is the ramifications for having him arrested going to be worse for him or possibly for you?

Hopefully, more private land owners open up land for riding since public lands are being closed all the time. Maybe eventually everyone will own a quad and the rules will relax as politicians have to think twice about voting against ATV iniatives.

Break? No way, he was on your property and obviously wasnt trying to "tread lightly". Unless he didnt know that he was on your property, then he deserves any punishment that law enforcement hands out.

Where i'm from the laws would have you charged with unauthorized possesion of property, but how about you work out a deal with him. ... You keep the quad for all the damage to property and drop the trespassing charges. Done deal!!

I think you should just go help the guy out and not tell the cops or anything like that. I mean, I guess the golden rule applys here.
