I have resently been caught on my quad going down a road (the only reason was because my friend was running low on gas) and i am scedualed to go to court on april 14th I was wondering if anyone knows anyway of fighting a charge of DRIVING WITHOUT A LICENCE i figure that i sould play stupied and say i though that was what the plate on the quad was for and that there isn't a licenece for quads so how can u charge me with that and how come snomobilers have right like driving in the ditch. I live in Ontario Canada and i was wondering if any one with the same crappy quad rules in there country knows andy way how to fight it or at least help all the ATV"ERS out ther get some RIGHTS

yea I live in Manitoba and probably have the same rules. I haven't caught yet and don't hope to be! My friend got caught they just brought him home and give him and his parents a lecture.

i live in the states. i was caught riding inside city limits because a butthead neighbor that doesn't like me called to police on me. i was charged with no proof of regisration, no proof of insurance and no helmet. the cop informed me that he was towing my brand new trx350fe because i had no insurance. i told him he never asked for it and dug it outta my tool box. he said he was towin it anyway since he already called for the flat bed. we exchanged words and my atv was towed anyway. another neighboor (that likes me) is a court clerk. I explained to her that atv's couldn't be licensed (therefore couldn't be registared) and helmets were not required. (the cop scratched out the no insurance part). she told me that the magistrate would side with the judge and recommended i just pay the fine. i gave her the ticket and the check and that was that.
the short and sweet is don't tell the judge the law. they make their own rules up as the go. they will usually side with the police unless there was a serious error made. playing stupid USUALLY doesnt work. at least in the states

if you check out the latest atv mag there is a comment that over 5000 atv's are licensed in europe. there are states that allow the licenseing of atv's on the basis of being modified for road use laws. that is you have a brake light, rear view mirror, turn signals,and horn. i am corrently negoiating with ky about doing just that. currently it is legal in oregon, missouri, florida, and utah. i think we are at the beginning of a movement to legally license four wheelers that will eventually take in every state. If you would like a copy of my letter to the sec of transportation i would be glad to send it to you. if you can license a mini-bike why not a atv?

Actually, Oregon has since revoked their decision for licensed riding of atv's in the state within city limits, or on any public road, for that matter. Idaho, however, has a law that says licensed atv's, with horn, turn signals and brake light may operate on any and all public roads or highways. One of the local dealers said he couldn't remember what the total was, but somewhere around $30/yr. or something around there. Don't know for sure. I just had to provide insurance on two brand new AC 500's, and that cost me $340 for the pair/year. Currently, the law in Washington says no atv's are allowed on public roads, however twice now, I have driven along side a couple roads and been pulled over by both a city cop, and a forest service/game warden guy. Neither of them asked for any kind of licenses, or tags. The city cop wanted to say they were nice bikes, and asked where we got them, how we liked them. The forest service just wanted to know if we had run into any elk, as they have been watching them in the area we were in, then said to have a good time and be safe. As of yet, I still don't really know the truth about what the laws are. I've asked everywhere, but get very different views from every source I contact. I would appreciate you letting me know how your efforts go, with your state, and also what your letter, or petition looks like, just in case.

I don't know about the judges up your way, but down here in Washington, all I can say is, don't give them any B.S., or make up any stories. Simply tell them the truth about why you were on the road in the first place. It may not get you completely out of trouble, but believe it or not, the judges can tell if you are lying, and if they have reason to doubt you, they usually make the sentence a little tougher than normal. Also, depending on how you present yourself in court is also a big factor in their decision. GOOD LUCK!

I had thought I heard on this forum about someone registering their ATV as a motorcycle with the state (I forget which state). They had to add on mirrors, turn signals and maybe a few other things. Probably the same modifications that had to be made to a on/off road dirt bike so it's road legal. But once all the mods were done they could go anywhere.

I was caught on the road here one time. The first thing I figured was "oh great" because people ram up and down the road here for fun on their wheelers and I figured I had just been nailed. The police officer got out, checked my registration to see if the machine was registered in my name and checked my plate to see if it was tagged for that year. She also told me she was chasing a group of guys that were playing on the road with wheelers and had no helmets and asked if I was with them. After I explained that I wasn't with them she said "well, at least you're wearing your helmet" and she walked to the car and said good night and I was on my merry way once again. Oh yeah, I also met the guys she was chasing on the trail!

Well guys, I figure it this way. If there are rules, just obey them. They are there for a reason. If you are breaking the law and get caught, don't complain about it, you were asking for it. And here is the biggest thing to remember. It only takes one bad apple to ruin it for the rest of us. If you do something stupid and just one person that is against ATVs see it, then you know that that person is going to blame all ATVers, not just the one they saw.

Just me 2 cents.

I agree, please dont give antiatv people anymore fuel for there fire or we will all get burnt.
