All the dale axles are very strong stronger than some of the aftermarket. You really cant expect them to cover that. he hit a tree after all. instead of looking for someone to blame he should be counting his lucky stars that he wasnt killed.I have seen countless axles snap on all types of quads and all the makers of axles. It happens.

Man that must be an incredibly ugly piece of twisted metal! How fast was he going?
Think you can come up with any pics? I would love to see it.
Glad he came out of it OK.

Unless the rider was under the named exclusion the insurance should cover it but why would they have to know who was on it?

How did breaking the axle trash the frame and engine, unless it induced a horrendous crash --- however, it may be argued that it was not the axle that induced the crash or damage, but the tree. The axle was just primary damage along with the rest from hitting the tree in the first place.

I would not expect that the dealer, nor Cannondale will do anything for him (nor should they) - not sure of the mentality behind holding them responsible for the rider hitting a tree. Insurance would be a different story.
