How to start a system

I am just looking for advise for how to start a trail system, the nearest trails from me are about 1 1/2 hours away and i live near alot of farm land thats 10 minutes away. I would just like some advise about organizing such a thing. Any help would be apprieciated.

My ideas:

Lease or own land. The Lease may be limited in nature, for example it may be a lease for a certain particular use only (ORV area).

If you are leasing land, then the landowner will have the following concerns:

1. trash
2. liability
3. illegal or improper behavior on the property.
4. erosion.

To answer those concerns, the lease should have provisions that your organization or club will maintain the premises, keep them clean, and that it will be responsible for proper management of the ORV area. It should also contain a hold harmless (indemnity) agreement, and a release from future liability (if allowed in your State). That should allay the concerns of the Landowner.

Next, are your concerns. You must protect yourself from possible liability. You may choose to use a voluntary pay system, as is used in the National Forests in North Carolina. There is an envelope dispensor. The rider takes an envelope from it, fills it out, and tears off a receipt, which he is directed to place visibly on his ATV.

If you do that, mmake sure that a hold harmless agreement is printed on the envelope with some sort of language in which the agreement is acknowledged by the rider. The agreement should hold you harmless for any claimsd by the rider, or anyone in his party. You should also have a Release from liability printed on the envelope with a similar acknowledgement. In some States, a release must be signed under seal (that does not mean notarized). Check with your local attorney. I would also suggest that the envelope contain an agreement to follow basic safety rulesm, which probably should be spelled out (such as helmet wearing, no alcohol or drugs, no reckless driving, etc).

Next, place safety signs at the ORV, such as "Drive Safely." I would also suggest posting safety rules.
