Thumbs down Riding in Michigan to get more expensive and confusing!

2010 Comprehensive OHV Legislation

Summary of changes:

References to "Off-road vehicle" and "ORV" in Michigan law would be changed to "Off-highway vehicle and "OHV" to reflect federal law.

The cost of an annual trail permit would increase to $30.50. Of that, $14.50 would go to trail maintenance, $14.50 to department operations, enforcement and special initiatives, $1 to OHV safety education, and 50 cents to the license vendor.

An annual registration of OHVs not already plated by the state would be established. The cost of the annual registration would be $6. Of that, $1 would go to the Secretary of State for administration and 50 cents would go to OHV safety education. The remaining money would be dispersed to county sheriffs where county roads are opened to OHVs pursuant to PA 240'08 in a ratio proportional to the number of OHV lane miles open in each county to the state total. The registration would expire on April 1 of each year. Otherwise, the registration process would be closely based on the current snowmobile registration process.

Along with a certificate of registration, the Secretary of State would establish and issue an identifying decal under rules promulgated by that department that would be displayed on the OHV. The registration decal would not be required for OHVs that are already plated through the Secretary of State or have a current plate or current registration decal from another state or a province of Canada.

OHV registrations would be included in the Law Enforcement Information Network (LEIN).

Any county, township, city or village in the state would be able to open its local roads under PA 240. PA 240 would no longer be restricted to northern Michigan.

The Michigan Transportation Commission would be able to permanently, seasonally or temporarily authorize the travel of OHVs on short stretches of state highways that have a speed limit at or below 45 miles per hour.

The location of operation on county roads would be clarified to include maintained shoulders.

The language allowing county road commissions to close up to 30% of county roads for environmental or safety reasons would be clarified to reflect the original intent of PA 240.

Language would be added to authorize local units of government to permit the travel of OHVs on roads maintained with state or local funds that pass through or along federal forest lands.

Penalties would be doubled for trespass on private and public lands, unsupervised youth operation and operating an OHV without a helmet except where helmet use is not currently required.

The definition of an ATV would be amended to reflect the language of HB 5087.

The MDNR would establish an OHV Safety Training Academy to train and license OHV Safety instructors. These instructors would be compensated through rules promulgated by the department through the OHV Safety Training Fund at a rate of not more than $20 per student. Licensed OHV safety instructors would not be allowed to charge an additional fee for classroom instruction but would be allowed to charge a fee for optional hands-on instruction desired by the parent or student.

A free riding day would be established the third Saturday in May where an OHV trail sticker or OHV registration is not required.

Liability limits would be established for trail maintenance organizations equal to that provided to organizations that groom snowmobile trails.

The threshold for an organized group event on state land would be increased to 75 vehicles unless the group is collecting a fee for the event.

Language would be added to define "primitive road" and clarify that primitive roads are closed to OHV traffic.

The PA 240 sunset would be removed.
Current ORV sticker fee is 16.25, proposed total ORV fees would be 36.50 per ORV per year more than double the current fee.
Will this hurt tourism in Michigan?
Will it make it more difficult for out of state riders to ride in MI?
Is this a good time for a ORV fee increase during the worst economic recession in many years in MI?

**** that.. period.. i am out of state and ride at silver lake sand dunes and that is just ridiculous!!!

This is not a good idea I am willing to bet that people from out of state will stop comming here to ride, and the people in the state that only got out for a ride once or twice a year will just stop going to the state land with there atvs

I don't live in MI, nor do I ride there, but reading the legislation makes it seem to me that they are taking ATV riding seriously. Things like trail maintenance will help long term and improve the conditions. Who cares about the $15 extra; that's a cheeseburger and a beer somewhere. I look at it as you are getting more entrenched within the state government and it will be harder for them to reduce riding mileage/areas going forward. It puts you all on a similar footing with the snowmobile guys that seem to get anything they want. -Maybe if the the $15 is a serious hardship, but most people on here spend thousands on their machines....tires, fancy synthetic oils, various racks.....Really, sounds like the best $15 you could spend to get more long term influence. If you were talking $100 it would be a little different. Although, I'd gladly pay that too for increased opportunity to ride and the ability to control the discussion. You don't want to be on the outside as a fringe group.....you want to get entrenched IMO. $ = influence

How cool is that. I'd pay $15 just to legally ride the roads when necessary, instead of looking over my shoulder for cops.

I think if it was a extra part for your machine its a no brainer to get an extra $13.75 on a quad, BUT and I do mean but the state has done nothing but take money out of our mouths for everything they can think of here. the fact the state wants another $13.75 for another unnessary program is bullsh!t! I stood up at the ORV advisory board meeting a couple years back when they proposed this then and told them it was going to hurt them. they sell approx 188,000 to 200,000 stickers a year. now if everone that bought 4 or 5 stickers for their machines and family says no to purchasing how will that effect them? secondly how about the locals who get by on section 8 because their are no jobs up around them? do you think they want another fee to move about withen this state?
if they enact the fee it will kill most orv tourism. if the cost for a trailer load of quads is $120-200 in stickers for one weekend I can see people heading elsewhere. secondly the people who live around the state who will ride illegally would become uncountable. if its the difference between a another 12 beers and a sticker guess who wins?

It's always aggravating to keep paying more and more each year. But let's look at comparables ---> $36 for a one year sticker vs 1 trip to 6 flags at $35 or vs a water park at $40 or vs a movie and popcorn and drink $25.

After I spend $10 grand to buy an ATV and trailer and gear what's $35 more dollars? I generally start balking at paying over $50, that's just my personal limit. Here is another way to look at it, $35 per year to ride public trails is cheaper than buying 100 Acres of land to ride on.

That's the cost of our entertainment. No matter what your entertainment is there is always costs involved. Camping has daily fees, watercraft has dock fees, horses require feed.

I live in Canada on the border with Sault Ste. Marie Mich. I do not get the $14.50 for trail maintenance, sure on groomed sled trails in winter but in the sport of ATVing the worst the trail conditions the better. LOL

The trails that I ride on they dont even groom or do any maitinece all they do is block off a trail once and a while and open up a differnt one, the onyl trails they groom are the sled trails so they are smooth for the winter. I ride the Gladwin trails just off of M61

This proposed legislation is redicules and im personally doing everything in my power to get it shut down.

First and foremeost, our current 16.25 ORV sticker fee's have been GROSSLY mis-used for AGES now and the DNR knows that some of us know this. How can ANY legislator [Sheltrown ] go to the people in the State of Michigan and request to legislation for a ORV sticker increase when they know damn well,

*Our trails have not been maintained to trail specs for AGES [ where is this money going? ]

*FMFM used up 485k dollars of our ORV dollars in 2008 and wont tell us where it went

*We have the worst ORV safety education program/instructors that is funded by ORV user fee's

*We dont even provide training to those ORV safety instructors hired under the adminstration of the DNR

*We have an ORV Advisory Board that is NOT selected by USER groups but rather the DNR Director herself.

*Our ORV Advisory Board has no legal authority what so ever for ORV issues

AND NOW THESE ***HOLES want MORE of our $$??

EVERYBODY needs to contact [ speaker of the House ] Andy Dillon

andydillon@house.mi.gov

And tell him that this legislation will be coming his way soon and request that oppose and shut it down.
