NEAR FATAL DECISION

Parents

Whatever you do stress to your kids the dangers of crossing the highway(besides illegal). I had a wreck wed night(9-8-99) because a 11yr old kid pulled out of his drive way on his ATV with out looking or stopping !! I was able to avoid him by only inches at the most. If I hadn't hit the brakes when I did I would have surely killed him. I ended up in a fairly deep ditch(no damage luckly) and had to be towed out and call the Highway Patrol. The kid is fine and so am I now(still a little shaking), but he is in some big trouble. They charged him as a juvenile and he will have to go to court. He's lucky that's the only lesson he has to deal with !!

I just bought a new Honda 450S last weekend and this has put a whole new light on riding for me !

Stump.
I hear yea.Look out for farmer field access crossing's On the trail your riding.Some are hard to detect and are not used verry much.

I was coming back home (rather fast)down a good trail after a thunder storm.And sudenly came and crossed two mudy tractor tracks after I crossed,I turned to breifly see a john deer full size tractor 30 feet up the cross trail.Man if I had came down that trail one minute earlyer,I don't want to think what could have happened.wow slow down.

I get nervous every time I see an ATV rider in the roadside ditch. Not your average rider, but the guy who is seeing if he can keep up with the vehicles on the highway, by going as fast as he can possibly go. Lose control and your history, lose control and land on the highway and your roadkill! Be sensible when riding in ditches and when making road crossings. TF

Yep. this guy just came out of nowhere. He might as well had a bulls eye on his leg, because that all I saw. I was driving a T-Bird and that car is heavy.

I think u are RIGHT AND WRONG FIRST thing he sholdn't have went out without looking both ways but I do beleave the quads shold be able to ride along roads (SNOMOBILES CAN) SO WE SHOULD AND I DO!!!! I THINK U BOTH WERE AT FALT MORE HIS THAN YOURS!!!!

In some states, an ATV legally may cross a road if the rider comes to a full stop (to check for traffic) and crosses the road at a right angle.

In the account of the near miss on this topic, the ATV did not stop. Assuming the automobile was operating within the legal speed limit and in good condition (the brakes obviously worked), how could anyone "FALT" the motorist?

Determining who's at fault does not change the extent of property damage or personal injury from an accident; odds do not favor ATV's and their riders in collisions with cars. Let's be careful out there!

I suppose he shouldn't have left the house that day.

First, the kid did something illegal (cross the hwy on an ATV), then something stupid (pulled across without looking and caused an accident). How does this equate to it being the driver of the car's fault???
I don't see anything wrong personally with crossing the hwy on an ATV, but you gotta make sure you don't interfere with traffic (Common Sense).

I just think that on the road, whatever which one, the cars have always the priority. So whenever you go or cross a road, u should alway check for car. Be carefull ppl.

The arguement of Fault can go on forever... but remember.. we ride ATV's.. Even the heaviest quad is NO MATCH for the lightest automobile... and Fault wont bring any of us or our machines back...
Thats JUST what I want to have happen, me and my Scrambler get stupid and try and go toe to toe with a yellow oil burning 1974 Ford Pinto Stationwagon.. What a way to go out... HUH??? Who cares whos fault it is AFTER THE FACT...
It really doesn't matter what your are driving.. car/semi/ATV/motorcycle.. WHATEVER.. DON'T be an IDIOT, and use some common sense, and you'll live ALOT longer..

Oh, AND PUT DOWN THE CELL PHONE AND DRIVE!!!! (makes a GREAT bumpersticker..)

Apperntly Sorcerer is a democrat. Hes trying to make the kid the victim in this case. Get real. The kid should shoulder 100% of the blame in this case.
