Well without a two-up atv it's illegal in every circumstance where a law enforcement group can ticket you.

 

kinda like riding to many in a car...but you know what! I once had cops tell us we could ride in the bed of the pickup, but you had to be 16...wonder where they come up with all these laws sometimes.

 

You can ride two-up here...but if passenger is under 18 they have to have a helmet. Straight from the mouth of a highway patrolman.

 

Um, we actually just ride.... how do you guys get caught??? I've never had a problem like that before.

It's against the law but I was wondering if any law enforcement agencies were actually enforcing this stupid law.

We have ridden two up at a state owned park in OK. Rangers have never said a word to anyone that I know of.

I think it has to do with the discretion of the officer. If what youre doing looks unsafe, or if the driver is under 18, then you might get stopped. If youre just driving along, and not doing something dangerous, like steep hillclimbs, or dragracing or wheelies, they usually look the other way.
Last year, in the state which allows nothing (minnesota), the legislature passed a law, making riding two up, even on a quad built for one, is now legal. This is how the law reads.

Passenger regulations with ADULT operators BeginningJuly1,2005 it is lawful for adults to carry one passenger on an ATV. • Passengers under 18 years of age must wear a helmet, on both public and private lands. • If the passenger is under 16 years of age, the operator must be the parent or legal guardian, or other person authorized by the parent or legal guardian. It is unlawful for a person under 18 to operate an ATV with a passenger, whether on public or private lands.

 

Does the new law state how they are to be seated? I've been stopped on a waverunner (no ticket), and was told to have the minor in front of the driver. I can see where this is good to keep an eye on the passenger, but would make operating the vehicle a little more difficult and dangerous.
