NC grandfather law for Polaris Scrambler 500
#1
we have a Polaris Scrambler 500. My husband bought it for his son (my stepson) new in 2001 (i believe...it might have been earlier). My husband and I married in 2003 (before the law was put in effect.) I didn't know about the Grandfather clause. What i'm trying to figure out is if my children fall under the grandfather law. They are 10 and 12. We have the original paper work showing we are the owners. Does anyone know?

Sorry, I typed my original post in a hurry.
We have a law in NC that states what ages and what CC's a fourwheeler can be driven legally. under this law, a 10, 12, and 13 year old would only be able to drive a 70 to 90 cc fourwheeler. which I think is rediculous, but what ever. My point is, I heard of a grandfather clause. basically what I heard is that if you bought the fourwheeler prior to a certain date, for your child you are exempt from the current law. My husband bought this fourwheeler for his son, and we married well before this law came into effect. Would my children as well as his be grandfathered in?

I personally think you are crazy to put a 10 yr old on a scrambler to begin with, regardless of the law. But also, the law would be better of with the child size also. My 11 yr old daughter rides a grizzly 125, but she is about 5'6" and a little over 100 lbs, and the grizz has a throttle stop if needed. In Texas, she should be on a 50cc, but that would look like a trained bear on a tricycle.

I do not agree with a 10 yr old on a scrambler either but here is the law.

If you read down near the bottom...
SECTION 3. This act becomes effective December 1, 2005, and applies to offenses committed on or after that date.
In the General Assembly read three times and ratified this the 9th day of August, 2005.

we have simlar laws here but i dont beleave they push them as long as the child is riding w/ an adult. you have to be 12 or 14 to cross a main rd by them selfs.

I appreciate your replies. The ten and twelve year olds aren't going to be doing any serious FourWheeling. I just needed to know if they could ride it at all.

Let me first say I don't agree with the law. But for the sake of argument..
On the Scrammy, is there a sticker stating not to be operated by anyone under the age of 16? The reason I ask, is there could be someone who sees that, and questions whether or not that could be considered child endangerment.
Yeah, that's a load of crap, but I'll bet somewhere there's a person (or group) that would try to push that.
Now, I say as long as your on private land, it shouldn't be an issue. But I would make the boys show me they can turn stop and manuever the Scrammy before letting them take off on it. If possible, I'd put a limiter on the throttle. That Scrammy has a whole lot of power, and they could be across the yard before you know it. And, as for all young riders, never unsupervised.
