Hey Klier.. i cant get that link to work..
anyway its almost midnite.. i gotta work in the morn at 8am.. so i gotta hit the bed..
nice to riding with you and we Will do it again.. maybe even get together with more guys from here too.

I don't understand why it would be illegal to ride at Roy Bauwers if you don't pay to ride? If Roy wants to let people ride ATVs on his property how can the county stop him. What would happen if Roy wanted to ride his own ATV on his property, could the county stop him? What happened to propery rights? The whole thing is crazy.

it would be illegal because Roy violated the conditions of his CUP and has been ordered by the court not to allow ANY recreational traffic onto the property.

Klier,

correct me if this is wrong. But this is what I have gathered from the whole ordeal.

Yup, that's pretty much what I gathered from it as well. There are posted no trespassing signs at the "usual" entrance now, at least when I went by early last week. I can't remember if it's a truck or if it's the old school bus that blocks the main entrance into the pit.

I have a feeling people are going to ride in there no matter what. I'd love to again too, but it probably won't happen legally for some time. The last time I heard about people being up there in Bauer's Pit on the police scanner, one of the deputies got stuck in his cruiser trying to get in there. Heheh.

You'd think people would be able to do what they want with their land, but big brother can take over whatever they want. The ironic part is police and politicians are no better than ourselves. It's all politics and special interests .. the golden rule means nothing. Just look at what the city of Morristown is going through with their police chief right now...

Of course, all of this is unimportant. The most important question to ask is, zButcher, when are you bringing that 6 pack over? [img]i/expressions/face-icon-small-happy.gif[/img]

The way I understood the counties ruling was that Roy was not able to let people operate ATV's on his property as a business generating revenue. My point is that I am not aware of any statutory law in this state that bars the operation of an ATV on an individuals private property by an adult as long as they are not in violation of locale ordinances such as noise laws. I'm not a lawyer but I'm certain that Ray as well as his family or friends can operate an ATV on his private property. I do know that there has been legislation introduced in the State of Minnesota to limit ATV use on private property but it has never made past conference committee.

ATC83,

you mentioned noise ordinances, and on occassion, there were complaints in regards to the noise. Although not all of the noise complaints were "off-road" related. The simple fact that Roy was charging a fee to begin with allowed the county to enforce their zoning ordinances. This in turn was the reason Roy applied for the CUP. We all know the outcome from there on out. There are more politics involved with this situation that 99% of us here don't agree with, but there's not really a whole lot we can do unless someone here can fork up $500K to buy the land or the $250K to get the pit in the condition it needs to be in for a GIA.


Rice County (BIG BROTHER) has spoken. Now we need to listen and learn.

250K to get the place fixed up?thats too high of a number to even think about covering with fundraisers.maybe i should go over to the prison and visit Jim Baker.he and Tammy Fay were good at getting funds from people,maybe he could give me some tips.

Hmmm ... Bauer's Ministry ... I'm getting a nasty idea.

I'm a legally ordained minister of the Universal Life Church. Anyone else want to get their instant ordination too? Heheh.. [img]i/expressions/face-icon-small-wink.gif[/img]

We could have a "church" of ATVs from miles around. Getting together and riding. Since it's a legal church, it should all be tax free too, right?

Nawwww ... I don't think I even want to go there...
