Contact Governor Gregoire to Urge Her to Veto Anti-OHV Provision
Budget Bill Passed by Legislature Forbids Spending on OHV Trails
A Conference Committee convened to reconcile differences between House and Senate-passed versions of a 2008 Supplemental Capital Appropriations bill, HB 2765, inserted language that bans funding generated from taxes on fuel used in off-highway vehicles (OHV) and OHV registrations from being used on planning, constructing or expanding facilities for OHV recreation for at least one year. The panel consisted of three House Members, Representatives Fromhold, Schual-Berke and McDonald and three Members of the Senate, Senators Fraser, Regala and Brandland. The Conference Committee inserted this language despite the fact that there was no public involvement or public legislative debate on the issue.
The exact language of the bill, which has passed the legislature and been delivered to the Governor, reads: "The department shall not plan for, or construct, new or expanded facilities or trails for off-road vehicles for recreation on state lands until after June 30, 2009, unless the project is already funded, has been considered as part of a landscape-level plan for recreation that has completed State Environmental Policy Act (SEPA) review, which included public participation, and is the best alternative to protect environmental or trust resources and public safety from immediate risk."
Please click the take action button to contact Governor Gregoire to encourage her to exercise her line-item veto power to remove the anti-OHV provision. The State of Washington collects taxes and fees from OHV users for the purpose of providing for increased motorized opportunities. This last-minute provision, if allowed to stand, would mean that OHV'ers would continue to pay for this program but would not receive the promised benefits.

Subject: Please Veto Anti-ORV Provision
Dear [decision maker name automatically inserted here],
Please exercise your line-item veto authority to remove the provision from HB 2765 that bans new or expanded trails or facilities for off-road vehicles from being planned or constructed on state lands until June 30, 2009. This provision was added by the Conference Committee at the 11th hour and was never subject to public involvement or debate.
As you are aware, funding for the Nonhighway and Off-road Vehicle Activities (NOVA) program comes from off-road vehicle permits and a portion of the state gas tax paid by users of off-road vehicles and non-highway roads (roads not supported by state fuel taxes). 70% of the funds provided to NOVA are earmarked for recreation facilities with the remaining 30 percent for education and enforcement. Last-minute language inserted by the Conference Committee in HB 2765 would exclude the very people who pay the taxes and fees from benefiting from this program.
The language in question begins on page 75 of the bill as delivered to you and reads, "The department shall not plan for, or construct, new or expanded facilities or trails for off-road vehicles for recreation on state lands until after June 30, 2009, unless the project is already funded, has been considered as part of a landscape-level plan for recreation that has completed State Environmental Policy Act (SEPA) review, which included public participation, and is the best alternative to protect environmental or trust resources and public safety from immediate risk."
Thank you for your consideration.
Sincerely,

Thanks for the update on the latest silliness from the legislature LdyJay. Taxation without representation has been addressed in this country before IIRC.
