HOEPIG! I have info for you!
#1
I have a '05 Traxter XT and I am having all kinds of problems. Two of the major problems were:
1. Rear brake caliper bolts came loose three months after i bought it and caused $900 in damage, not to mention loss of braking power.
2. Front right balljoint seperated at 40km/h (CANADA, eh!) and I crashed the quad. Minor injuries only.
Anyway, the result is me refusing to ride the quad any longer. This is were the info for Hoepig comes in (may help or not)...
Up here in Canada, we have a law called the "Sale of Goods Act" which is basically a law that protects buyers from Lemons. It applies to any merchandise that is purchased "new" included cars, appliances...and yes ATV's. I would imagine that the US States may have similar consumer protection laws.
I argued with BRP head office instead of the dealer I bought it from for about a month and a half and finally BRP put me in a position where I would have to sue the dealer. The Sale of Goods Act applies on the contract of sale between me and the dealer, not BRP. The dealer has a case against BRP.
Bottom line is that the dealer has agreed to settle with me after one conversation and the threat of the lawsuit because I was backed by the consumer protection laws. If you write another letter to BRP, send it to the same people I am dealing with and let them know we have talked. They are well aware of my situation because I am serious about suing them (no need now though).
Don't give up, fight for a new quad.
