Default Problems getting BRP to honor warranty?

I have an '07 800 max xt with 65 hours on it. It went from still pulling hard at 78 mph when I let off it (18 hours on it) to topping out at about 65 mph now. The shocks and springs are gone, the winch is intermittant, water gets into the cvt while going through foot peg deep water, the trans has made a grinding noise (intermittant) when braking since new. I have had it in the mud, I have had it in water up to the headlights, but this quad has always been treated with kid gloves, I didnt pay $11,000 to trash it. 99% of the time on this unit is trail riding at 15 mph with my kids, 6 and 12. Bottom line, the dealer wants me to authorise $450.00 to diag and submit warr. claim, on top of the $170.00 oil change they call a 50 hour service. By the way, the techs notes on the back of the service invoice say "rear shocks weak, front shocks blown out". I even called BRP, got a case # and they still wont even look at warranty issues unless I fork over $450. Funny how they changed the design on the shocks from '07 to '08.............

Sounds like a dealer issue more than anything. $170 for an oil change and $450 to diagnose? Both sound like robbery to me. That's not BRP, that's the dealer's doing.

Are there any other dealers around that you could take it to? There is a TSB for the CVT cover letting water in so that is a warranty item. The topping out early may also be related to getting the belt and stuff in there wet.

I've taken it to two dealers, the one that I bought it from for the 10 hour service, they didnt reset the maint. reminder, and wouldnt check the winch without diag time auth. At that piont I had used the winch 5 times, once to pull myself out., 4 times to pull others out, it wouldnt pull back in 3 of the 5 times. The second dealer ( much closer to me) said there were no tsb's or recalls on it according to the vin. As for the top end, I had thought the same, so I tried it totally dry, same. Just a note... when I start it, it would say maint reqd soon......High speed. the second dealer also forgot to reset the maint. reminder, had to bring it back. they cleared it but it still says "HIGH SPEED" when I start it. The "best tech" in the shop had no idea what it meant and still cant give me an answer.

50 hr service my Polaris was 200, they changed all the Oil's. if that is the case with your 50Hr then 170.00 sounds fine. Sounds like they want to remove and disassemble the transmission. That is why there asking for the 450.00 labor. That labor charge is problely for disassemble and reassemble if they find out it is not covered by the warranty. I am not sure what your manual says for service, but as long as you have followed it and had all the service done according to the manual intervals the transmission should be covered. They might find water damage in the trans and that could lead to a denile of warranty. After Deep dives all the Fluids should be checked to see if any water has entered the cases.

There is definitely a TSB for the tranny leaking on all models prior to 08 so if your's is an 07, it is covered. If the best tech doesn't understand how to get the error codes off the machine, then you really need to find another dealer. Again, both of these items lead to it being a dealer problem.

Here is the TSB info for the CVT. Your machine being an 07 is covered so they are BSing you.

Just a question, what did they place in the display as your greeting at startup? It should start with "HI" and then whatever they add.

Forgot to say that while the belt may be currently dry, the leakage may of caused a problem that needs cleaned up. Also the belt could of been damaged if it had gotten wet and run like that. Both no fault of yours unless you took water in the snorkels which is very possible if you went headlight deep.

If your check engine light is on, you can get the codes yourself.

1: Turn on your key to lights on position.
2: Press and hold the mode button while quickly toggling the Hi-Lo switch. A minimum of 3 Hi-Lo toggles must be completed in 2 seconds.
3: If no codes, it will say "No Active P Codes". If there are any set, then they will be displayed followed by END. An example of a P code would be P0106.

On the tranny grinding sound, it is probably just the way the rear brake setup works. Since the brake is on the driveshaft, when you brake, you can get various strange noises when the play goes back and forth between the brake area and the tires. Not really grinding though as the tranny has nothing to do with your braking.

Thanks for the code retrieval input! I had assumoed the trans noise was due to brake input to the trans through the drivetrain. Niether of the shops input my owner info into the pcm. When I had to bring it back to have the maint. reminder cleared, the codes in it were for pcm/cluster mismatch, low voltage and for high voltage. The tech kind of fumbled through the program on a laptop a bit and said it was fine. I'm not so worried about the trans noise as the suspension issue. The shocks are shot, its even noted on the work order by the tech that did the 50 hour service, and they wont warranty them without me giving them $450 auth. to diag and submit the warr. claim. I have B.E.S.T. warranty with a $50. deductable and I dont think they want that much because they want to tear down the trans, my mani concern was the susp. and I made that clear to them.

What am I missing? sounds like you trash it.

May be your not reading MY copy of the B.E.S.T warranty that says suspension, $50.00 deductable. And lets clarify.... I think mud..not axle breaking mud holes surrounded with beer cans and a crowd of people seeing what it takes to break thier ****, but MUD falls under the realm of ALL TERRAIN. Secondly, when I had it up to the headlights in water was last week, I live in Florida and its rainy season right now. the trail was washed out and when I got through it (easily by the way) I put it back on the trailer. I dont jump it, or do wheelies and so on. I just dont think the shocks and springs should be shot with well under 50 hours on it. And it seems BRP feels the same way, they redesigned them for '08. And as for the FACTORY installed winch with the bad soleniod, I think that falls under the part of the warranty that says "electrical systems- $50.00 deductable"
By the way JMR, where do you ride, on your front lawn?
