Warning to all atv riders. i purchased a brand new Can Am DS450 xmx from Performance East Inc or East Carolina Powersports from out of state. When the bike arrived at my house i notice the bike had been used. i figured since it was a 2009 model it would have some wear from the show room, but this bike had been used.

The first clue that i has been ripped off was when the bike would not start. i replace the battery and got the bike to run. But once the bike warmed up it would stall and would not start. after several tries later I gave up and took the bike to the local dealer in Miami.

The Dealer plugged the computer in and we found that the bike had 22 hours and no service. Later the dealer calls me and tells me that the bike had been over filled with oil and all the sensors needed to be removed and cleaned. No big deal the bike is new and should be under warranty. Wrong! Since its a human error to over fill the bike with oil Can Am will not cover this repairs.

My issue with Performance East and East carolina Powersports is that they sold me a used bike as new and not properly maintained bike. I call, and they do not respond, i email them and they call the local repair place liars.

Do not buy or deal with Performance East and East Carolina Powersports

these pictures were taken on day one before i even rode the bike. note that i have had the bike for 2 months and maybe rode it 1 hour. the bike has been in the shop for the last month.

i also posted this in the "Buying an ATV" section.

Default That sucks.

Didn't they give you some sort of warranty when you purchased the bike?
With customer service like that, they won't be in business for long. Have the new shop give it a good look over, maintain it yourself and you should get many great years out of it. 22 hours on it is nothing. It's still a new bike.
Basically, it's already broken in for you. Good luck.

the other part of the story that is not complete yet. the bike has been in the shop for a month now. at first the bike's Warranty was void due to, to much oil in the crank case and ignoring the 10 hour service. I filed a complaint with Can Am and they honored the warranty (thank you Can Am).

at first they did the 10 hour service and replaced the battery. once the battery was replaced the starter was worn out. replacing the started got the bike running, but their was further damage from the over lubing. the engine computer sensors were damage and dirty. after replacing the computer sensors , the bike fired up but is not running as it should. so now they have taken the engine apart to find what other damages the bike has. all this for a so called new bike.

the point of the story is i paid for a new bike "out of the crate" like they told me, not a broken in, lack of maintenance, and broken bike.

With CanAm agreeing to repair under warranty and your local dealer being able to document everything along the way I would say that you have a pretty decent court case.

yes, i ask you how much would a lawyer cost and would it be worth to fight in court. if i go to court i will not be able to ride the bike till this is setled. correct?

i just think that sharing my story online will help future shoppers. this was a online sale and since i'm in Florida and Performance East in in NC they took advantage to get rid of this bike.

Interstate commerce laws would take affect on this. They could be in some real trouble.

What about your State Atty General? They will have a consumer complaint division.
Once you call them they should be able to tell you
1.If you have a valid claim
2.how to persue it
3.give you an idea if it is even worth the effort.

Agreed. The dealer is held responsible for false advertising. They must have really abused it for only 22 hours worth of riding. The starter went that quick! Something is not right about your whole situation.

yes. i found the bike and dealer through BRP web site. once i found who had that bike i communicated via e-mail and phone. mostly e-mail so i have documentation.
