That is an interesting issue. I would check the bracket itself to see if it is bent. Maybe came that way from factory...

...plus Kerbbirds does have a good point with the shock settings. Wonder if it could also be an alignment issue (toe in / toe out / etc)...

Good luck...and please post back.

Yeah both shocks are set to the same setting and it cann't be a toe in or out setting as its the rear tire nothing there I can set.
Asked my buddy tonight who aslo has an 850 but just a single seater if he had any problems like this he said his rubs on the right hand side but it seems to hit the swaybar.
He said he thought it was because we both have wider then stock tires but on the single seater the sway bar is in the front of the tire the two up the bar is in the rear.....Still looking into this.

I also have an 850 touring. I have switched to ITP XTR Mudlights and it started rubbing. Funny thing is my left rear only rubs when I go over a good bump.. I think it is hitting the bolt that holds the fender bracket. The bolt that you have to remove to remove the fender bracket in order to access the belt/clutch cover. Every time I hear it rub I get out and look for rub marks. Nothing yet but I'll keep you posted, Thats my best guess for now. (Its the only difference I can think of from left to right side.) BTW the rear sway bars are different on the touring versus the short wheel base models, I had rubbing issues there as well until I used spacers.

Turbeau thanks for the input I knew the swaybar set up was different on the two but just something else to look into I guess. You say yours rubs on the left side aswell I've looked and looked the only thing I see is the bracket/bolt for the fender and the swaybar is pretty close with the wider then stock tires if you come up with anything keep me informed thanks
