Hi All,
New to ATVing, I got what seems like a nice deal on a 2008 Sportsmen 800 efi (only has 50 miles on it). Anyway, my questions is that considered a two person machine?

you can easily ride 2 people on it, if thats what your asking. but i dont think they actually consider it a 2 up unless it has the 2nd person seat. If your wondering if the police will get made at you for riding 2 up then no they wont unless they are really big ****** in your area or there is a specific law on it, otherwise they're cool with it.

Technically it isn't but check online for the DNR regulations in your state. Also, get in touch with any local atv clubs and they will have some firsthand knowledge on what/how the regs are enforced.
Pretty lenient here in MN on two-up but that all depends on what you'redoing at the time when you encounter an officer. Rode 800's for years with my daughter on the back before she was old enough to have her own legally on the trails. Had a rear cargo box with a pad and always wore helmets with no issues.
Two-up regs are kind of iffy IMO. I can see if you have a racing quad or something but the only major difference between a regular 800 and a two-up model is the two-up has a backrest and passenger foot pads.
