Is it illegal to ride two people on a four wheeler in Illinois
#4
In Illinois it's illegal to operate any motor vehicle with out proper license and since you can't license a atv in Illinois, it's not legal to operate it with one person little on 2. However if it's used on private property or land leased to a private individual, it can be used with out law enforcement intervention as long as there is consent to operate it on that property. Tresspassing is tresspassing and the fine for that now is $1000.00. Also it used to be up to the land owner to post the property. That is not the case anymore. It is now up to the tresspasser to know where he/she is at all times. Ignorance of the law in tresspassing used to get you off the hook but it doesn't anymore. It then becomes the landowner/leasers rules that are in place, usually governed by the insurance company that covers the land. The insurance company is going to look at what the manufacturer recommends as far as the policy is concerned for the leassor. That being said, if you own the property and you choose to ride double, no skin off my back. If your on my property or public property, new ballgame. If I choose to ride double on my land, I don't want you or anyone else telling me I can't. I take into consideration that my insurance it going to not help me and that is my risk. Sorry I was long winded. I now hand the mic over to the next person.......

Just a note to those who say riding 2 up is unsafe
get a life its not unsafe to ride 2 up for casual trail riding. If your flying down the trails thats another story as 2 people can hamper your ability to turn the 4 wheeler at high speed. If you were Say Honda would you not say 1 rider only also if just for the purpose of having one plaintiff instead of 2 incase of a lawsuit? I beleive that's why they put that on the bikes. After all the lawsuits in the 80's from idiots riding 2 up at high speeds on 3 wheelers breaking their spines then sueing saying the vehicles are unsafe. How is it unsafe on a 4 wheeler but safe on a say... streetbike? which is obviously a more unstable machine.

There is no specific law against riding with a passenger on an ATV. There probably should be, but there isn't. Keep in mind though, that according to the IL law, you are directly responsible for that passenger's life, and in the event of an accident which results in their death, you will be charged with reckless homicide. This is a class 3 felony. If the act involves being under the influence(of anything), that changes it to a class 2 felony, which will get you 3-14 years in the pokey. This is from the state criminal code Ch. 38, par. 9-3.
