Hindsight is always 20 / 20 right? One thing I do when I sell a Car / ATV / Whatever is make a bill of sale on my PC. Something simple - I can send you mine if you want free. Basically you make it a 'binding document' using those words specifically, signed, with the vehicle & selling price etc outlined clearly, that way no matter what 'bank' paperwork hasn't been done, you've got a legal document that states what you traded or bought or sold. I'm really sorry that your friend is a moron. If you need that bill of sale let me know, I'd like to help however possible.

Do you have ANY documentation as to the trade? Depending on how you feel about this deal I think you could have an excellent case in small claims court - or the People's court on TV.

After reading this I have to question who's at fault here. Yes, you should have had the paperwork done. But it also sounds like you were about to stiff your buddy with the knowledge that your quad was about to break. Unfortunately it broke while he had it and then backed out. I give the guy credit for offering to pay for the repairs and what do you do? Tear up the money? He even offered to give you more if the $70 wasn't enough.

I was just in Pearson wisconsin today riding my wifes scrambler in the mud and snow . What is in need of fixing on your DS? Im 2 hours from you, and am in the antigo area once a month for work. Also hunt in pickrell (sp) and fish up there on the wolf at my buddys grandparents.

Sound like you sort of got screwed.

Thanks for the offer to help blackhawk, but we didn't write anything out so it was just a verbal agreement untill we went to the bank and get the names switched over on our loans. Plus I wouldn't take it that far anyway, it was both of our faults for not going to the bank sooner and getting it done and over with.

LEP7MM, this same friend was the previous owner of my DS before I bought it the first time. He himself bought it brand new for something like $6400, and in the first year of owning it he had over $6000 worth of warrentee work done on it. He knew what he was getting, trust me. We were both even talking about how much stuff breaks on it but that didn't bother him at all at the time and he was all for the trade! I was a little surprised how ambitious he was about it since I didn't think I had a preachers chance in hell that he was gonna wanna trade. I just brought up the idea and he pretty much did the rest. He came over the next day and was like MAN I WANT THIS QUAD BACK! So we traded and all was cool. He rode it a couple days and was talking to me about how much he liked having his quad back again. I was happy to have the bike so I thought all was good. HE KNEW what he was getting and I didn't screw him in any way unless you can tell me how I planned a waterpump seal failure and a torn valve cover bolt gasket after 2 days in his possession.

So ya that's what happend. He started the quad up in his garage one day to go for a ride and while it was sitting and warming up he went in the house for a second. He came back out in his garage and it was steaming/smoking and oil was all over the motor. He shut it off and just called me to tell me what happend. I knew it was a valve cover bolt gasket that have broken or cracked because it happend to me once before... Or twice.. Anyway, he's not real mechanically inclined so I told him I would fix it since no one around here knows more about that quad than me. I told him to drop it off and I'll get at it as soon as I could. A couple days later he was just looking his quad over a bit and decided to check his coolant. The radiator was almost empty. So he was checking it out a little more and checked the oil too. The oil was all milky and excessively full. He told me this and I was like, oh great, waterpump seals again. I said no big deal, I'll fix that too. So I planned on fixing it for him and I figured no problem. Hell, we were talking about it yesterday for crying out loud and he seemed fine about it. But then I brought up that my Dad was going to the bank tomorrow to get the loans switched over and put the bike in my name and everything. Apperantly, he got the bright idea right there that technically, he STILL owned the bike and I STILL owned the quad...... Well today he did what he did and there wasn't anything I could do about it.

What I plan on doing is getting my DS fixed and trade it in on a different bike or if I can find a slightly used yfz450 since they're expensive new. I'm not positively sure what I'm gonna do yet but I gotta get this thing fixed and the hell out of my sight.

Hey berksglh, we should get together sometime and go riding this summer. PM me or something.

Just get that thing limping and trade it off.......I'd say its time to cut the losses and get another ride that you can do just that "ride". I think all of us have been in your shoes in some way shape or form......so your not on your own......good luck
