trouble with my traxter...things aren't good

Over the last few months, I've been hearing a strange 'hydraulic' noise from the engine during the warmup cycle. this noise gets accentuated by upshifting. I finally decided to bring the monster back to the dealer.
The straight skinny is there is some type of ball and spring that controls the oil pressure that actuates the shifting machanism. After two weeks waiting for parts, The dealer replaced this (based on i/p from BOMB). Well , supposedly it help the situation but didn't cure it. So now, the delear needs to yank the engine and 'perform major surgery' (his words) based in i/p from BOMB.
I'm getting nervous about this. It's been almost three weeks and it will be another two before it's done. I'm not very happy with BOMB and how they've supported my dealer (he's alright) with this issue. I've already contacted the attorney general in my state (NY) and they informed me there is no 'Lemon Law' in my state. I was told to contact the manufacturer and file a complaint. I plan on doing this tomorrow.
I guess I'm wondering if anyone has had a similar problem with an ATV and how they handled it

Don't let them do it, they did the recall on my XT just to find out that it had it already. Two weeks and if ya go in you'll see they rip the thing apart from an engine pull to pulling the tranny apart. After all that they put a new selinoid in the spring. If yours doesn't have the recall I guess ya kinda have too.

A few points to ponder for you,
1-Bombardier reads these pages usually.
2-You will find the slowdown is not with Bombardier, but with the dealer or his lack of communication with Bombardier.
3-Its amazing how one of the first things you do is contact your attorney general. Sounds like your expecting a free lunch? Why not ask the dealer to take a greater interest in your needs, I have to assume the dealer took your money quick enough, now it is their responsibility to provide responsive / speedy service. LOOK at your dealer first. I know from experience Bombardier will solve any problem very speedy if they are aware of the full problem. If the dealer is mousing around, no one wins.

I contacted the attorney general to see if there was such a thing as a 'lemon law' for an ATV. I was looking for information not a 'free lunch'.
I spent 6100 (plus tax) on a machine that, in my opinion, is not being properly (timely) serviced under the warranty. I was looking for other folks that may have experienced a similar situation.
I'm curious as to why you would suspect the dealer? The owner has personally spoken to me numerous times and mentioned that the support from
BOMB was slow and , in some cases, wrong. He told me that BOMB was pressuring him to not warranty the bike if the 'first' fix didn't correct the problem. Why would he lie?
The more I think about your 'free lunch' statement, the more angered I get. What's a free lunch...an ATV that works correctly? If so, then I guess you're correct. Otherwise, I'd be interested in an explanation of a free lunch

No luck. If anyone has any info on how contact BOMB via email or a phone number...that would be awesome.

Mr. Johnc ,I was also wandering what was meant by the "free lunch" analogy? Its funny when people assume and speculate on situations they are not fully informed on. I had lots of problems with the honda dealership and the regional bufoon concerning a very expensive warranty issue with a 400ex. I feel the continued letter writing to the dealership, Honda the bbb ,DA helped solve half of the issues I was having with Honda and the dealership. Short of legal action, I feel making your voice heard is about the best you can do.Maybe I am wrong? I hope your situation will be quickly resolved. oh yea, I sold the bike after.

JohnC, I'd look at the dealer. Here's my 2 cents.
I've read the good and bad on this board about traxter and still got one. Put 300 miles on it and brought it back for the check up along with the items I'd heard here and by word of mouth, and of course my use of the machine. My dealer/tech working on my machine was aware and unaware of some of the items that I thought were wrong. Hydro sound/shifting, defective selonoid and backfire on occasion. His bottom line is they'll fix the problem, period. The tech pulled out a recall sheet of some sort. These are items that are replaced or fixed under warrenty or whatever. These are bulletins of information for dealerships to abide by in fixing items free of charge to consumer, covered by dealer or mfg, or good ole cash. Turns out that some of the things wrong with my Traxter were not covered by mfg but covered by the dealer, and some of the things that were working properly now, but may cause problems in the future were covered by mfg, not the dealer. It's important to know because dealer and mfg sometimes have a split on covered fixes that generate cost. Also, important because a dealer will get his cash either from you (easiest), contract with mfg on certain labor and parts, or have to fight for payment of services from the mfg, based on your problem,(most difficult). Think of it like this, when your bike left the dealership, add another $$$ to the price you paid because you will be back for maintenance and checkup's and If your dealer can get paid for warrenty work from the mfg and still do repairs due to your driving habits or usage, you are considered a cash cow, (good customer). These recall or fixable items are normal and happen all the time. You won't know about them, only tech's and dealers, and there not going to call you each time a light bulb is recalled and under warrenty. Information is the key. If you have a good relationship with your dealer then ask him about seeing the messages or recall or under warrenty fixes (I'm not sure what the actual information is called). You may have a lemon but I really don't think so. You may have a problem with your dealer though, not Bombardier. Bombardier is not stupid, if they've tested traxter they know exactly what will go wrong and how it will go wrong and when it will go wrong by each of about 1,000 different driving conditions. Bombardier puts it all in writting and circulation via distribution lists. I'd be surprized on the AG response and Bombardier's on your matter. I believe both will respond with dealer responsibility.

Bombardier is great about fixing problems? Email JamesDS650 and ask about how great they are about customer service. His dealer bent over backwards to try and solve the problems he had with his bike, going above and beyond what Bombardier recommended after their advice proved worthless. In his case, after a few months of having the bike at the dealer the majority of the time, Bombardier only became helpful after the threat of legal action. He's happy with his DS now, and I really want a Traxter, but I won't hesitate to make their customer service and legal people nervous if I buy one and they drag their feet on getting things done.

I can only speak for my own situation. My dealer will bend over backwards and almost any other way to please his customers. He backs what he sells -period. I have not had anything major go wrong so far with my machine - after 1 full year and over 600 miles. The minor stuff was taken care of with no questions asked. Bombadier makes the highest quality of machines from my own experience with other brands. I am sorry to hear about your situation and only wish you could talk with my dealer to get a fresh start.
