A Minnesota man has died in an all-terrain vehicle crash which happened after he struck and killed a dog.
Sheriff's deputies say the man was driving his ATV when a dog ran onto the road from a farmyard. He struck and killed the dog, then ran off the road and into some trees. He was found lying nearby and was airlifted to a hospital where he died from his injuries. Authorities say he wasn't wearing a helmet.

Sad, on both deaths.
Why would it go to court? Riders family suing the dog oweners? Don't know the legalities there about riding on the road, or the helmet laws. But the bit of information you gave says nothing about the speed he was traveling either. Dog owner suing riders family? Again, don't know the laws there, but a simple dog at large (have one here, rarely enforced) could get that tossed.
But, PETA, CPSC and tree huggers get together, and the riding community is surely going to lose.

We could use more info re: speed and why he was riding on the road. He was not necessrily riding illegally. My firsthand experience says a farmer is liable if livestock get out on a road and cause an accident. In my case, there was no death, luckily, and dogs and cats, unlike other livestock, typically run loose in rural areas. I've heard of motorcyclists dying when they hit deer, which also typically run loose. Still, I would think the dog owner is responsible.

Hmmm, guy is probably driving illegally on a public road with no helmet. Dog probably is supposed to be on a chain or under direct control of owner. It'd probably get thrown out. Bad timing on both of their parts.

I'd say more info needed.
Was this an area with a leash law, or was it free range area where livestock has right of way?
Was this an area where riding on the road is illegal, or where ATV's can be on the street with no helmet?

No, i dont know MN ATV laws so i wont comment. But i do know that animal owners are liable for animals in the roadway that cause an accident here as well.
