Is the spring that pulls the lever up gone?

I had that same problem with mine last spring. Try taking the lever off and clean it well and throw some lube on it. I would scrub it good with a wire brush and then hopefully it'll be all good.

yeah I cleaned up the whole thing quite a bit on the shaft and the brake lever. Then when i slid it back on the four wheeler i worked it up and down alot with the spring off to make sure it wasn't sticking.

MY 400S LEVER WAS COMPLETLEY FROZEN. TAKE ALL THE STUFF OFF TO WHERE ITS ONLY THE LEVER THEN SPRAY WD40 BEHIND AND IN FRONT AND JUST WORK IT UP AND DOWN 10 OR SO TIMES THEN PUT MORE WD THEN A FEW MORE TIMES AND IT WILL COME FREE. MINE DIDNT COME OUT THE HOLE EITHER TO CLEAN IT OFF BUT IT HASNT FROZEN UP YET.
