Permission to ride
Thanks for that fellas, i'm fairly new to this and its good to see that there are good people out there that will take the time and effort to educate this younger, irresponsible, generation. I come from a town in southern Kansas and when i was a snot nose, i rode on a guys land that was right beside a county rode. He came and chewed us up one side and down the other. I had no idea what the guy was upset about. We were ripping through a muddy area and thought nothing of it. The point is of course, it was his land, not mine. I had no business being there for any reason. I was just being destructive and selfish. This guy had farmed the land in that area since he was young and had been in his family for generations. Who did i think i was...he probably should have shot me.
I just wanted to share that i understand why there are rules to life. Follow the rules OR sell your bike. Don't make it harder for everyone else.

That is one of the most redicaulous things I have ever heard, its not the land owners obligation to tell you not to ride on there land. If its not yours than stay off.
We have a creek that runs down the middle of one of our places and a road down the side. We would drive by and people would be fishing off the bridge or be fishing off the bank around the big hole under the bridge. I asked my dad why he let them do that. He said that not everyone was fortunate to have tanks and creeks and everyhting like we do so they should have a place to fish too.
For several years this is the attitude we kept. Then we started seeing trash, lines, and tracks up and down our creek. People started following the creek and would go a mile and sometimes more onto our place. Then we started having stuff missing from our barn and other problems with gates being opened and stuff. We were shooting skeet off a cliff overlooking the creek and two guys came walking down below us while we were shooting acting like we were't there or something.
To make a long story short we have put a stop to all of that. We can do nothing about people fishing off the bridge but no one is allowed off any more. Its really sad that we had to do this and ruin a good fishing spot for alot of people, but the few that took advantage of it ruined it for everyone else.

All you guys are missing the point. My major gripe is why do you buy land, spend big money for land and do nothing with it? It don't make sence to me? If you own the land im on all I ask is be a man and tell me you own it and I will tell you im sorry and leave, no problem, but I do have a problem when you threaten me without me knowing I did anything wrong, if its your land or not it doesn't give you the right to threaten to hurt or kill me. State owned trails for ATV's to ride are a joke, the State has **** Police that harrass everybody, the trails are straight and level, they don't offer any rough trails that are tough to ride, its a joke like your riding on a merry-go-round and everybody must go slow, stay on the smooth trail, don't stop to take a leak or the rent-a-cop **** police may get mad, ohhhh nooo, im scared, please don't yell at me , im sooo scared fat, overweight rent-a-cop, your so tough, and im sooo scared of your authority.

No you are missing the point, as stated before, ITS NONE OF YOUR BUSINESS WHAT THE LAND IS BEING USED FOR. IF ITS NOT YOURS, STAY OFF!
Alot of people buy land for tax write offs or if they are like my uncle to build on at a later time. He bought several hundred acres that he goes to maybe three times a year because he travels alot with his job. His plan is to be paying on it now and when he retires he will build there. I take care of the place for him now. Good care! LOL Alot of good hunting and atv riding on that place.

As a matter of shear coincidence we were contacted this week by our insurance carrier. They wanted to know if we allowed access "to the general public" to any of our property. Seems if we want to continue to do this it will result in a rate increase. Our options will be to pay a higher rate, post the property and require a written liability release from anyone we allow to enter or take our chances of being sued without coverage by some idiot that refuses to respect our rights. If we elect to post the property we will then be responsible to make a "resonable effort" to enforce the posting. This would include calling the Sheriff's Office when violators were seen.
Some choices huh! My first reaction is to just say "To H with it" and post the place up tight. I really don't want to do this and we will probably pay a little more and go with the written release idea. Hope the "reasonable effort" part isn't too stringent.

As a hunter you must be aware who owns the land you hunt on. That is part of the responsibility that goes with the state issusing you a liscense. Unfortunately most states only make you do something similar to ride on OHV, state or federal lands with motorized vehicles.
Also, as far as owning property and allowing people to use it to hunt on, ride bikes, or atv's. Landowners need to be aware that they can and ARE being held liable for injuries to individuals who use their property that occur on their property. Just look around and you will find a landowner in court for this. So if this is the case what incentives or choices are we, as atv riders, giving land owners except to close their lands?
So we as the users had better do our homework and find out who owns the land we use, ask for permission to use it and don't expect permission to be given just because you ask.
Just my 2 pennies worth.

Instead of whining and blaming everyone else for your personal circumstances, why don't you put some money where your mouth is and buy land offering riding conditions you're after? If you can't do that and dislike public trails, maybe you don't really need an ATV.

This guy could lead people to join the minuteman project. Why do some people assume they have control over property that is not their own?

You guys ever hear of "Squatters Rights" ? If you didn't I suggest you look up ur state and local laws and read and learn it. All that you guys need to do is put up No Trasspassing signs and thats enough to claim your land as you own it, BUT if I don't see any No Trasspassing signs I am in my legal right to enter your land, and you have no right to tell me to leave unless you show me proof that you own it. I have liability insurance on my ATV, that covers me and the land owner if I get hurt or injured on anybodys land. If you call the local police on me, you must provide proof that you told me to leave, or proof of ownership, and or no trasspassing signs. If the land owner wants to get violent with me, I still have the right to protect myself no matter if you own the land or not. All you have to do is stop a person on your land and be nice and friendly and inform him you own the land and you don't want him on it, and I will be nice and friendly back to you, tell you im sorry and leave. I had issues with past land owners, and one land owner I have permission to ride on his land, I recieved his permission cause I found out he owns it, his name was clearly marked on his no trasspassing signs, I went to his home and knocked on his door and asked for permission, proved to him a good responsible rider with the proper insurance and registration. All im saying is to you land owners is be a man, and don't be afraid to tell another man that you own the property.

You state may differ, but the one I live in and 40 others define trespassing as entering private property without verbal or written permission of the deeded owner/tenant, implied consent. No signs required. One telephone call and our sheriff will cite you for criminal trespassing and you'll be civilly liable for any damages you may incur, including disturbance of ground cover.
Because you're too lazy to check property records on your own and contact owners for permission to use their land, you expect those owners to post their names and telephone numbers for your convenience? That has to be a new high point of immediate, self- gratification.
