Is this only a recommendation or is this law that a rider under 16 cannot operate an ATV over 89cc?

Recommendation by the manufacturers. The only time this comes into 'law' is that a few private riding spots have chosen to adopt the under 90cc/under 16 thing to ride on their land. Most deaerships can not knowlingly (wink,wink) sell you a larger quad for your kid without risking the wrath of their manufacturing supplier.

In most states as long as you are not ona road that is open to cars it is just a sugestion. there are several states that have made it law. This garbage all came from the comsumer product safety commission. They got together and came up with these guidlines that the ATV manufactures agreed to so they could avoid a complete ban on ATVs. Check with your state recreation department they should be able to tell what the laws are were you ride.

Ky has adopted the law,

if you go riding at LBL you have to sign a
form stating the fact.

but, I have seen kids there riding bikes
larger than they are suppose to..
