Default Oregon ATV legislation - Act now!

Good news! It looks like the bill was modified to allow kids to ride on private property but not public land. This legislation that you supported now does nothing above current law to ban kids from riding on your land. It also makes your land more attractive for kids to ride on because as you said, the consequences for trespassing are almost nill. I guess it's time for you to spend more of your $$ on surveillance systems to notify the sheriff when somebody rides on your land. I'm sure he has nothing better to do then rush out and chase kids away. lol
Hasn't happened but once since the security and signs were installed, but we are still in winter. I live in the country and city people can't get ATVs or dirt bikes here without a trailer, which eliminates all but the very stupid. If necessary, and I don't feel it will be at this point, I'll add armed response to my security company contract and the sheriff's department will have to respond to the immediate security company response and detainment of trespassers that I'll have my lawyer sue for terrain damage, as permitted under Oregon's trespassing legislation. I'm done with it. There's always a way to legally avoid unnecessary annoyance.

Default Oregon ATV legislation - Act now!

Reminder,

Oregon riders are encouraged to oppose SB 49, which seeks to outlaw ATV and motorcycle riding for all youth under age 12. SB 49 would ban all youth riders, age 12 and under, from motorcycle and ATV riding, even on private property, and limit riders under age 16 to vehicles 90 cc's or less.
The full text of Senate Bill 49 can be found at www.leg.state.or.us. This legislation has been proposed without any consultation with the Oregon riding community, the AMA, industry or even state parks. The motorized community must be given an opportunity to weigh in on this legislation prior to it being introduced. Use the AMA StateWatch section of www.AMADirectlink.com to email your message making your feelings known, and also be sure to let other riders know about this important issue.

It's a shame you are dealing with kids invading your land - but how many of them are under 12 years old.
My bet, this bill will do nothing to help that problem.

Senate Bill 49 "Kyles Law". Here are various quotes from Sue Rabe, Kyle's mom, member of Safe Kids and ATV Safety, and the source from which it was obtained.
We have all documentation if needed. Please read what she has said, then read just below to the contract she completed stating she wouldn't allow anyone under 18 to operate the ATV. She also declined free safety training for her family.... Your comments are appreciated! More comparisons and information is available. Thank you, Lindy

Did the dealer really fail to inform her???

"We were horribly uninformed" said DeLoretto-Rabe of Turner, Ore

assoc. press Elizabeth Wolfe

The dealer they visited sold them an adult-size machine with full knowledge that Kyle would use it

The Vroom Report

and did little to warn the Rabes about the dangers of ATVs.

The Vroom Report

never thought the dealer would sell them an ATV that wasn't safe for Kyle to ride

Corporate Crime Reporter

Rabe says its easy to ignore warning stickers, especially if dealer don't mention them"

Kids Death Spur ATV backlash

Our dealer too shares the blame

letter to me

He picked out the machine for us and fit Kyle on it when he was only eight

letter to me

His mother said the salesman never mentioned the potential dangers.

assoc. press Elizabeth Wolfe

"The dealer came to our house and trained him on it."

Kids Death Spur ATV backlash

If the dealer didn't sell us a 250cc for Kyle to ride but instead a 90cc, he would be here today enjoying life?

letter 2/7

a careless and deadly mistake on our part for trusting the dealer

letter 2/7

He (dealer) sold us a helmet and trained our son

letter to me

If I had known the danger, I never would have let Lyle ride the machine"

Kids Death Spur ATV backlash

If the Atv industry's approach to safety actually worked, Kyle would be here today because he would never have been on that ATV.

The Vroom Report

This lack of information can have a devastating impact on America's family ( referring to the dealer)

The Vroom Report

"the industry needs to make it impossible for a child to ride an adult size ATV, or we need to make laws so they can't"

19 Corporate Crime Reporter

It would have saved our son's life if there had been a law that said he was too small..(Sue)

Corporate Crime Reporter

Because there was no law prohibiting it, the Rabes thought is was safe.

Corporate Crime Reporter

Please see the attached purchase contract to see how informed she was..

She promised not to let anyone under 18 ride it and she declined the free safety training offered!!

I have a copy of her signed contract but don't know how to up load it here.
