West Virginia's Tomahawk MX has been dealt a serious blow by a Berkeley County noise ordinance that limits daytime noise to just 60 decibels and refuses to give the motocross track exemption.
Berkeley County Commissioner Bill Stubblefield, who also successfully sought to have the nighttime decibel level reduced from 55 to 50, agreed that the proposed motocross exemption was problematic.
"If we make one exception, where do we draw the line? If we make an exception for the motocross, why not the local bar?" he said. "I believe we have to treat the businesses the same."
"It is also important to consider property owners," Stubblefield said.
As approved, noise levels in residential areas could not exceed 60 decibels from 7 a.m. to 10 p.m. It will be lowered to 50 decibels from 10 p.m. to 7 a.m.
Petrucci, speaking during a meeting break, said he had no regrets about his position or vote.
If this 60 dB level can be passed in one county, it can happen in other countys and other states just the same!

Wonder how well that will go over with people who like to use stuff like leaf blowers, weed eaters and lawn mowers?

No kidding..... I guess everyone in the county has electric mowers? Or really small 3hp mowers? Dunno but 50dbs sounds impossible for an ATV or dirt bike.... I guess some of the Utes with the hunting exhausts are OK but I don't think there are any sport machine anywhere close to 50db.

That same politician should stand in front of his constituants when they start losing the revenues that are generated by ATV's and he has to find ways to replace the funds. (Hello, can you say increased taxes). WV is very big on everyone's list when it comes to riding ATV's and finding ways to generate replacement revenues for a failing coal industry. THIS is a real good example of what MODIFIED LOUD EXHAUSTS will do to the sport. Like it or not, there are many places that flat tell you to stay home if you have a loud exhaust. Keep the factory pipes...

Yet, another, "feel good", chunk of bad law where the people making the laws don't use their heads. The use their emotions to decide about a law or how it is to be enforced. It's ridiculous. People ought to stand outside his house with decibel meters and see how badly he is braking the law.
