sounds like a case of not enough riding experiance to me, don't get me wrong, i do feel sorry, but according to what they said: "the 11-year-old turned too tightly" learn your limits

11-year-old Crystal Kowalski was riding an ATV on her friend's grandfather's land south of Apple Valley, when it overturned on top of her Friday afternoon.
A group of Crystal's friends and neighbors gathered at her house Saturday, discussing the young life that was tragically cut short. They remember Crystal as a great friend and student, and a dedicated ice skater.
Crystal was not wearing a safety helmet.
Minnesota law requires ATV riders on public land to be at least 16 years old. If riders are between 12 and 15 they must pass an ATV training class offered by the DNR.
The Dakota County Sheriff's Department says because the girls were on private land, it is likely no charges will be filed.

thats really horrible. the thing that scares me is that down my raod there is 2 lil girls i always see on this huge polaris sp500. they can't even reach the floor boards. they ride double and have no clue what this machine can do. and they and wearing shorts n flip flops, with out a HELMET! even i always wear a helmet because it only takes a second for your life to change. these girls were prolly 7 or 8![img]i/expressions/face-icon-small-frown.gif[/img]

this is a very unfortunate story. As an instructor here in MN, it really hits home. This is what we try to prevent, but it still happens. I would suspect that no charges will be filed against anyone simply due to the anguish that those involved have to endure. The way the Sheriffs Dept stated it, it completely contradicts state law.
It doesn't matter if they were on private land or public land, at 11 years old, she was too young to be riding a full size machine. State law requires they be atleast 12 years of age, possess a certificate for successfully completing the MNDNR safety training, and be under the supervision of an adult 18 or older with a valid drivers license.
