Here's the newest information reported in our local newspaper:

Campsites will remain open to ATV riders

By LUCILLE HUSTON, lhuston@reviewonline

SALINE TOWNSHIP ? All-terrain vehicles can still be ridden on three Jefferson County campsites, according to officials and camp owners.

While officials are distributing flyers telling ATV riders they will not be permitted to continue riding on private land in Jefferson County, campground owners are letting riders know they may still ride at the campsites.

Three campsites are located within the area including Forbidden Zone, Yellow Creek and Oak Tree.

Warren Springer, owner of Forbidden Zone, said signs have been posted telling riders to enter the campsite from the township road. Persons transporting ATVs to the campsite should take state Route 213 south from state Route 7 about 3 1/2 miles, then turn right on the township road. The campsite drive is about 1.2 miles on the right.

Asked how many ATV riders he has at the campsight, he said it is unpredictable. There may be only two, or there may be 200.

Springer said the riders are told about property lines. He said he does not have a fence separating his campground from private property. He believes the, instead, the private owners should erect no trespassing signs.

Springer insists he has right of way for the other entrance, but admits trucks have to travel over the railroad to reach the right of way. The railroad officials say they plan to start enforcing laws.

Springer cited state law on right-of-ways, saying when two roads were vacated by Jefferson County Commissioners in 2001, it left him with the right-of-way. He says there is no private property between the township road and his property. He later gave the name of a neighbor whose land the right-of-way does go through, saying this neighbor wants to use the area for a landfill.

Meanwhile, the law on ATVs on public highways has been clarified by the Ohio State Highway Patrol.

According to Chapter 4519 of the Ohio Revised Code, authorization is given to utilize all-purpose vehicles, including snowmobiles, to cross a highway other than a limited access highway or freeway.

Authorization is given on county and township highways whenever approved by those having jurisdictional authority over them.

The Ohio Highway Patrol says this means the county commissioners must approve the use on county highways and the township trustees must approve use on township highways.

Chief Kenneth Hays of Saline Township Police said Jefferson County has not approved highway use. The OSHP says to their knowledge, Columbiana County Commissioners have never approved highway use on county roads either.

The law also permits the berm of shoulder of any highway, other than limited access or freeway, when the terrain is such that the vehicle can be used safely. The law does not interpret who determines the safety of the roadways.

Any accident involving the vehicles is to be reported within 48 hours.

An official with the Ohio Environmental Protection Agency who works with Jefferson County said the area has been investigated because of the proposed landfill. A public hearing was not required, but was held. This was in 2004.

He also said because of the steep terrain in the area, the Department of Natural Resources which handles land reclamation has expressed concern about ATV riders. They have questionsed the injuries which have resulted.

The law also defines the vehicles. A snowmobile is a self-propelled vehicle steered by wheels or caterpillar treads or a combination of both designed primarily for cross-country travel on land and water.

An all-purpose vehicle is any self-propelled vehicle steered by wheels or caterpillar treads or a combination designed primarily for cross-country travel on land and water or on more than one type of terrain.
