Default MX track design and legal issues question.

I’ve started building a MX track with a buddy of mine. We’ve got about 30 acres and access to large yellow iron. So far we’ve built two tabletops and one double just messing around. Next weekend we’re going to get serious with a D8 moving the big stuff and a D3 for the touch up. When we get done if it’s not too sweet to hold onto for our own little honey hole we’re thinking about opening it to the public as a practice track. Anyone know where I can check out the legal issues with charging money to ride and us not having to get layers involved if someone breaks a leg?

Also if anyone has any great ideas on track design we sure could use some help.

I bet the biggest hurdle will be Insurance.

It may be cost prohibitive.

Try the NOHVCC or write to any of the ATv/Dirt Bike magazines....

Can you get around insurance if you make people sign a waiver or put up a sign that says, "RIDE AT YOUR OWN RISK"?

Find out who owns a track near you and go talk to the owners. No need doing a bunch of leg work that has already been done by someone else.
All the MX tracks here in ND are owned privately or by clubs, so it can be done.

You better check w/ your insurance co. Anyone can get sued. I built one also & I'm very carefull who rides there. Not only do you have to worry about someone sueing you for getting hurt but you really have to worry about that persons insurance co suing you to re-coupe their losses. If someone is crippled for life where the costs would be VERY high, then that persons insurance co will come after everyone they can to get back some of the money. Small cases arn't worth their time. You can't stop your insurance co suing someone. My friends insurnace co sued his own father & he couldn't do anything about it. He got hurt in a farm accident.

Well it happens to be that I'm about a 3 miles away from the other track that's around here. I'm just thinking they'll be kinda hacked off that I'll be taking business.
