2007 Arctic Cat 400 Shift problems

I have a 2007 Arctic Cat 400 4x4 Automatic! Less than 10 hours on the unit !
Here is my problem.. In order to shift from low to high or high to low high, low into reverse or neutral I have to turn off the key then shift gears - and then restart it in gear. It's been like that since I purchased it at the Bass Pro shop back in March.. I took it back to the Bass Pro shop and the service guy told me it's just the nature of the unit and if I rocked the unit back and forth that it would shift into gear. I think he is full of it, because if you stall out on a hill you sure can't rock it back and forth!
It seems that it is a little better now that the temp has warmed up I'm wondering if the electric choke maybe causing it to idol too fast?
Anyone have this problem besides me?

the tech is partially right. sometimes you do need to kind of shift your weight front to back to shift. but a high idle will make this issue alot worse that it should be. you shouldnt have to shut it off to switch gears. if you look at your carb(right side) there is a black tube with a **** on the end it can be tough to see but its there. if you twist the **** to the right you increase idle and if you turn the **** to the left you decrease idle. you want it to be low idle but no so low that it stalls try lowering the idle speed and see if it helps. this issue will get better as the machine brakes in too. it will never completely go away but it will become alot less. ive got it now that a very light rocking will do it or if its tough i will tap the throttle very little to get it to come out of gear.
