No I'm not whacked. I know how much time and energy goes into this stuff. After you win that judgement, there is a 50% chance or better that they will appeal and you will not see court again for almost another year in many cases. Meanwhile you have to worry about every little thing you say or even joke about because someone was listening and might use it against you somehow in court.

About you sueing Audi, I bet you would sue anyone at the drop of a hat based on your comments in the past about BRP. Some of us have a higher threshold on what constitutes the propriety of legal action.

I will defend myself agressively but the only time i would ever sue someone is for the principle of the matter. Never for the money.

You are wacked you nut job! We went after a major, major auto player and I told you how it worked and how it happened.

I did not pursue BRP b/c it was not worth it. It was only a $7000 machine from BRP. My Audi was close to $60,000. Am i pissed off at BRP? You bet! I just vowed to never buy a BRP product again for the crappy way they treated me. Arctic Cat and Yamaha have seen my money since. About one more year of my Outlander and it will be gone also.

So go %$&$% yourself for judging me with my lawsuit and with BRP!

Thanks for making my point. You originally asked if I was whacked because I asserted that you really need to be fighting over at least $25k to $30k for the lawsuit to be worth his time. I also made the point that a chassis and $3500 was not worth the hassle of turning over to our legal system by hiring an attorney............apparently neither do you[img]i/expressions/face-icon-small-wink.gif[/img]

You were willing to sue over a $60k purchase but you decided a $7k purchase wasen't worth your time to take to court.

Been through it twice in 12 years business. Not because I wanted to but because it was a matter of principle. I won once and lost in appeal due to silly rules lobbyed by the insurance industry.............The jury was not allowed to know that the lady had insurance. They were forced by law to assume I was suing her personally and the other attorney made it sound like she was going to be put out on the street if she lost.

It was interesting, I was driving down the road in the country. She pulls out of her drive way right in front of me causing my truck to flip over her hood. Her Insurance company denies liability. To collect from them to fix my truck the law only allows me to sue her. I can't sue the insurance company. I waited to see how bad the damage was and in the mean time I get served papers, lmao! She decided, "what the hell! Maybe I might win". I hired an attorney and defended myself and won. The case was thrown out with prejudice.......meaning it could never be brought back up again. I was pissed about that whole thing so I went ahead and sued. It was over about $11k for truck damage. I won the arbitration and they awarded me $13k plus they paid my attorney. Well, even though I won, the insurance companied offered me $3k or they were going to appeal. I declined and 10 months later I was in a courtroom with a jury. Well, in this 10 month period of time this lady was diagnosed with Alzheimers and was unable to appear. The insurance company's hired attorneys had a hay day with the fact I was a young man sueing a 60 year old lady with alzheimers and was going to put her out on the street. The jury bought it and my attorney choked and I had to pay out of my pocket $2k in mine and their court fees plus a $500 prevailing party fee...........to the insurance company!!!

It can be cut and dried that you are right but you still take a risk by taking legal action and if you plan to take risk, it better be over enough money to be worth it. I just wanted my truck fixed and she was liable as was her insurance company. Didn't happen that way...................

just a little update craig from cp customs held up his part of the deal, the bike is getting custom painted and then it will be on its way out here. we will see if it was worth the weight.[img]i/expressions/face-icon-small-smile.gif[/img]
