big ben, I have talked to the seller and expressed my concerns with the bike. He has some local offers and we made some agreements that if I chose not to buy we would come to some terms on his listing fees.

You found a flexible seller. If I were in your shoes, I'd rather buy that DS for the $2400 than pay the listing fees and get nothing. But it's between you and the seller, as long as you both are happy with the final outcome.
I just have bad memories about the motorcycle I sold on ebay only to have the high bidder back out. I didn't have time to take any action other than sell the bike for a lot less than the final bid. (I was selling because I had to move and couldn't take the bike with me). That guy cost me 1/3 of the value of that motorcycle.

I COMPLETELY UNDERSTAND. HE HAS A BID $25 LESS THAN MINE AND THE BUYER IS WILLING TO BUY FOR THAT PRICE SO WE ARE AT THE POINT IF HE WOULD LIKE, THAT I WILL MAKE UP THE $25 DIFFERENCE.
