Actually, there is no law governing the top speed of a quad. It is only a voluntary gentlemen's agreement between the manufactures so that a law isn't drafted to put such limits on them. And the actual agreement is for below 78 mph.

i got this info from a technical advisor at Bombadier when I called about regearing my Baja X. I called and complained that I was hitting my rev limiter too fast through the gears and when I was topped out in 5th gear. It was explained to me by the techie that Bombardier undergears the DS at the factory in order to stay under a certain mph which was told to me to be 78mph. He explained that due to a manufactures agreement and insurance purposes the limit is in place. He also told me that for insurance purposes that he couldn't advise me as to what the proper gearing for the powerband is. (the DS's motor is virtually identicle to the BMW streetbike motor) So, in a nutshell that is the story of how I got the info. It sounded reasonable to me, so I thought I would pass it on in a reasonable way. By the way, I did regear my Baja X with a 17T front sprocket +1 from factory and now get 81.9 mph out of my quad.

I don't see the 450r going that fast top speed because it is a low end, low revving machine. If it gets up to high speed it will be on a long long run because I don't think it will be gaining RPM easy with its design.
