03 Foreman ES shifting problem or ?

I have an 03 Foreman 450ES that has about 700mi. on it. When it's cold and I have it choked and want to shift from Reverse to Neutral or from 1 to Neutral it will not shift sometimes until I turn the choke off, but then the engine wants to die off sometimes.
Also wondering how deep of water this ATV can go thru as I have a creek that sometimes can have water to the top of the tires. (stock tires by the way).

That might be the safety mechinism getting in the way. If you were to release the brakes, and let it roll on its own...would it? Is the idle so high, that it would go on its own, choke on in gear? Can it go up to second, but just wont go into neutral, from first?
The computer might be thinking, that its going faster than 2mph, (even though the brakes are on,)because of the higher rpms, and therefore blocks out nuetral.
You might want to try turning the mixture screw on the carb , out 1/4 turn...it makes the drivability much better when cold. I can remove my choke with in 15 seconds, of starting in 20 degree weather.
If you remove the seat, youll see the intake snorkle...thats how deep you can go.
