Getting a DUI/DWI while on the trail

Great reply's, NorthernEdge: I am in my second year of criminal Justus and applying for reserve positions but College is getting to me as they are all liberal and I am not learning anything worthwhile. Anyway, He wasn't impaired, just affected but still blew a . 08 and they did fool around for what seemed forever wasting time. He is smaller than me at 5'9 and 140 pounds and never drinks. The law enforcement officer was a forest service officer that was about 30 years old and clearly against ATV use. He also stated that they ticket roller bladers for DUI also.

you better not be driving that Sears 10HP lawn tractor,or operating your weed whacker,[they're also motor driven].I'd hate for you to stop half way thru the job on a 95 degree day,stop for a couple of ice cold bruskeys,than hop back on the tractor or operate the weed whacker and continue cutting the rest of your grass.Would your neighbor call on you and get you arrested for DWI?Could they than yank your DRIVERS license?Hope not.After all,you are still OPERATING a motorized vehicle [lawn tractor,anyways]

Truthfully, you should be careful on that Lawn Mower. Back this summer a guy got a DUI on one near where I live. Imagine how many small children he could have killed when the 5mph beast came at them. They'd only have minutes to move out of the way.

There is no place for drinking and ATVING OR SNOWMOBLING or any other motorized sport.

1 beer, two beer where does it end. I will not ride with anyone that drinks while out playing. The sport should be enough fun with out the drinking. One or two beers is enough for some to get buzzed off, now he crashes into your buddy and kills him. What do you do then? Drink a couple more and carry on. It's stupid do not do it, not even one.

In Maine it does not effect (at least it did not when my friend Mike got caught a couple year ago, things could have changed by now) your drivers license, you get a fine and that is about it, allot of people on snowmobiles get dui's never heard of an atver. But I am sure they have, I know a friend got caught on his dad's farm tractor, and another on a riding lawn mower! I have some beer and ride always have and probably always will, I don't get drunk but, it is safer to take the atv or snowmobile to the bar then to drive, Maine cops are predators, and they can stop you for anything, so I ride my off road machines to the clubs. It is crazy a guy cannot have a few beers and mow his and his neighbor’s lawn! Come on that is getting crazy. But it happened to a friend he was driving the few hundred feet to his friends on Sunday afternoon, cops pulled him over and bang OUI. Cars I can see, but lawn mowers, roller blades and thing s like that nope, he was harming no one by going 3 or 4 mph on the side of the road to his friends. I am not a fan of law enforcement people; I have only been stopped for speeding once in my life and once on my ATV a few weeks ago. Other than that nothing, I do not drink and drive my vehicles. But I have never met a decent cop; they all have major attitudes as though they are better than others or me. I wonder what it takes for a person who wants to make a living stopping people for going 32 mph in a 25 mph. I got stopped and got a ticket for that when I was 19, 7 mph over! It was 35 at the beginning of the road it turned to 25 no sign! It got stolen and was not replaced, I tried to fight it, but they said that was no excuse! 66 dollar fine and the day off from work with no pay.

Greetings,

There was a famous case in Ellicot City Maryland a few years back about a guy being arrested for DWI on a horse. Its a small, historic town with a narrow hilly main street and the guy was riding down it in a state of high intoxication. If I recall it correctly, he was beign pretty wild and chased a few people etc. He fought the charges for years and finally had them dropped because a horse is not a motor vehicle.

As for the lawn mower thing, have any of you seen that movie where the old guy rides a lawn tractor across Iowa to see his long lost brother? Its a true story, but I kept wondering why he never got hassled by the police along the way.

Don't get me wrong, I don't like beer but do enjoy my Tequilla & Yukon Jack.

We were at a local riding area & there were some young (early 20's) guys slamming a few beers in the parking lot of our local riding area. One had a scrambler & the other a older Yamaha. I thought no big deal, until later down the trail I am following my kid who is going 10-12 mph. These trails are only 1 quad wide maybe 2 motocycles wide. Anyways, I see this Scrambler hauling butt out of the corner of my eye. Well the kid runs off the trail & I jump off my quad to help him. The next thing I know here comes this scrambler flying around the corner almost running over me, then he loses control & wrecks. We exchange a few words. They go around & continue down the trail.

Later back in the parking lot there they are drinking again. The kid & I get back to the parking lot & the guy on the scrambler yells something at me. Well I proceeded in calling the local Sheriff on the cell phonen & when they showed the guy riding the Scrambler ended up in the back of the Police cruiser.

I do not mind people drinking responsibly. But when you endanger me & my kid, thats a different story.

Would I do this again, you bet I would.

Its a revenue generator. Cops here will keep harrassing/testing you until you get busted. Say you blow a .07 like my buddy did, that is passing, but the officer then made him do a FST, again passed. So the cop makes him wait for 10 minutes to see if maybe some beer was still in his gut. After ten minutes he blows a .08, busted for DUI. Thats corrupt.

I recall back in the mid 80s if you were on your snowmobile or quad, that you could ride the forest roads from town to town,bar to bar without the cops even blinking an eye at you,just so you were'nt in an automobile.Man,did we have some safe/enjoyable fun too.Allmost all of us would of blew over the legal limit back then.Im here to tell you,we were SAFE riders,not ever a single accident related to the booze and quads/snowmobiles.I know what your going to say,most people dont know when to say when.Our WHEN would of been over the laws legal limit to us.As I said before,each persons tollerance is differant.

We had TONS of fun and directed thousands of revenue for them towns to.They depended on our sport for their personal up keep of their establishments.I see that many of them have went out of bussiness today.

.08 alcohol content = less snowmobiles and ATVs
Less snowmobiles and ATVs = less revenue
Less revenue = possible loss of bussiness.

I to am not really a big fan of law enforcement officers,most of them are hard core *****s around here.I once had a close friend named Dan who was an officer.We partied very heavy one night.We were pulled over by the State Police.Dan was driving.As soon as they seen Dan was one of them,that was the end of the story.We continued on to the next bar.What a bunch of BS.Dan further went on to say that there is a ''COAD OF SILENCE'' within most every Police dept,another words,they dont bust they're own,
