Eton 70-too big for 7 year old?

I don't plan on enjoying my machine until I have quads for my wife(again) and for the kiddos as well. So I've been doing a lot of shopping and investigating. Until recently, I didn't know that the age thing was law. I figured it was a liability driven suggestion. Nope. 2500 bucks! I actually met somebody that got the fine, AND got the machine confiscated, too.
I think it's ridiculous. I know an 11 yrs old, a son of a friend, that is 6 foot tall. Do they expect him to ride a 70cc? Granted, I'd just have him lie if he were asked, but then again, he probably wouldn't get asked.lol

is it a state law or is it federal? when we're on public lands, the park rangers have never said anything. they've only checked out our ATV safety course certificates that we carry with us. i found this article, but i don't know how to look up laws with numbers on the feds website. but here's an article i found. don't know if this is bogus or for real.
