RockBottom341@aol.com had an ad in the classifieds for a 38mm Kiehin PJ for $100 that he said was in good condition. The carb is in terrible condition. The worst problem being that the throttle cable boss on the cap is broken. He claimed it was broken in shipping and that he would contact UPS about getting the insurance to pay for it. The break is dirty and the piece was not in the box. I decided that if he was going to resolve it, I would not confront him on it. After nothing seemed to be happening, I sent an e-mail yesterday. I asked for a refund and I would send back the carb. I have gotten no response.

It is not just the cap. The carb is in terrible condition. I have never seen a carb where the chrome was worn off the slide. The slide bore is also worn. This wear causes the slide fit sloppy. Air will leak around the slide making it a jetting nightmare.

You might think I should expect wear in a used item, but carbs should not be worn out. The original carbs on all my machines are older than your 250R and have no signs of wear. That is why I was willing to buy a used carb.

In all internet transactions, it is standard practice to allow return with the buyer paying the return shipping with a full refund. As for you losing potential buyers, I have lost potential purchases of a good condition carbs. I have purchased thousands of dollars in used items through the classifieds on ATV Connection. In the few cases where I felt the description given to me by the seller was better than what I felt the item was. There was no problem in returning the item. I can tell you this, had you sent me a picture where I could see the carb slide through the bore, I would not have purchased the carb.

I do not see where your dealings on EBAY are relevant. I sold the stock carb off my machine. The guy who bought it realized there was nothing wrong with his. I bought it back. He paid shipping both ways since it not a problem with my carb.

The impression you gave me with saying it was broken in shipping was that I would get the $100 back. Whether that came through UPS or through you, I did not care. I was not going to make a big deal out of the condition of the carb if I was getting my money back.

I called UPS. There were no incidents reported on that tracking number. He never called them.

I'm not a lawyer however maybe you should talk to one. The law most likely states, "buyer beware" however you have his e-mail messages to you and you checked UPS's report history. What he did to you wasn't fair. He sold you something that was not what he claimed.

Further inspection of the carb reveals a bent needle that has been ground on. I believe the grinding was done to hide the fact that it had been bent much worse and was straightened out.

Not sure how you paid for it but it if was a postal money order you might want to get the post office involved as that could be considered mail fraud. When I had a problem with a purchase that was recommended to me. That is why I use postal money orders.
