Default China atv 110cc brake problem

I bought a new 110cc Peacesports atv for my son. It had a lot of minor issues right out of the crate but I was prepared for that. One bigger issue I have is the rear disc brake. It rubs constantly when running due to a wobble in either the disc or the axle and it soon heats up and then the machine has trouble just moveing. I took the caliper off and strapped it up under the seat so he could ride it. Someone suggested I just have too much fluid in the system.
Anyone have a suggestion?:

you've bled it and used DOT 4 brake fluid? take the disks out and make sure the factory put them in correctly and didn't lose any parts on the caliper.
