Need serious help-2002 Polaris 700

So here is the deal. I have been to another ATV forum with good results, but I haven't hit the jackpot yet. I bought a brand new Polaris 700 back in 2002. It has never run right since the day I purchased it. It has been sitting idle now for almost 10 months, every time you run it, the crankcase fills up with gas. It has been in the shop eight times, before and after the warranty period ended and just about everything has been worked on. Repairs done & checked for: bent vent tubes, changed needle & seats in the carb, entire new carb, float adjustment, removed spacer between carb & head, stating there was vibration in the engine causing the gas to fill the crankcase. The problem still exists and the machine runs worse than ever, it now backfires, misses, no idle, stalls. This was all done at the dealership where I purchased it, they did do work on it well past the warranty without charge. Polaris customer service is the absolute worse I have ever encountered. When I have called in the past, I have not been able to get past the customer service reps, they refuse to transfer you to upper mgmt. As of February of 2003, I have retained a lawyer. Even when the attorney has made contact with them, they refuse to take any ownership of this and we will be going to court soon. But I am sure they will draw this out I have heard they could appeal and this could go on and on. I guess with sales in the billions, one person doesn't matter and they have the money to jack me around. It sure would be easier if I could find someone out there who knows the problem with this machine. Any help would be appreciated.

Well, being in the automotive industry it sounds like it can fall under the lemmon law. If it has been in for the same problem 3 consecutive times and still has not been fixed then it is a lemmon. Even after the warranty has run out because the problem existed prior to warranty running out. You need all receipts and documents about the same complaint.
