4 wheel drive wont shut off?! Would a broken axel do this?

Default 4 wheel drive wont shut off?! Would a broken axel do this?

So last night i was riding my 2004 sportsman 500 HO and i had been using the 4WD allot, when i was driving on the road i turned it off but then i felt the quad jerk because the 4wd would kick in for a second, then this morning i took it out in the snow, i noticed my read right axel didnt turn At all and the tire had to power to it, i just took the wheel off and saw that the inside of the cv joint was shattered into a few pieces, i plan on replacing the axel but would this cause the quad to go into 4wd? Is it sensing theres no traction? The last time i changed the front housing fluid was allitle less than a year ago, we also just put new bearings and seals in it but noticed the rollers werent in the best shape, any help and recomendations would be great!

Possible if the broken rear shaft turned fast enough the front could kick in. Replace the drive shaft(s) and see if it solves the problem. If the awd still kicks in when not under a load, might be time to change the hub fluid again or check out the front hub awd system. OPT

Thats my guess also,rear brocken shaft is still spinning and fooling the locking front hubs that it has a rear wheel slip.
